3 3.2. The bids may either be submitted at the place indicated above up until the deadline date and time of the tender or they can be sent by registered mail. The tenderer shall check the conformity of all the documents with their respective originals and their completeness. After this inspection, two copies of a memorandum which indicates that the tenderer has received all of the documents in line with the originals are signed. Ayrıca, bu Şartnamenin ilgili hükümleri gereğince, idarenin düzenleyeceği zeyilnameler ile isteklilerin yazılı talebi üzerine idare tarafından yapılan yazılı açıklamalar, ihale dokümanının bağlayıcı bir parçasıdır Furthermore, addendums prepared by the Contracting Entity in accordance with the related provisions of this Specification as well as written explanations made by the Contracting Entity upon the request of the tenderer constitute binding parts of the tender document İstekli tarafından, ihale dokümanının içeriği dikkatli bir şekilde incelenmelidir. Teklifin verilmesine ilişkin şartların yerine getirememesinden kaynaklanan sorumluluk teklif verene aittir. İhale dokümanında öngörülen kriterlere ve şekil kurallarına uygun olmayan teklifler değerlendirmeye alınmaz Tenderer should carefully examine the contents of all documents mentioned above. The tenderer shall assume any responsibility arising from non-compliance of the bid with the requirements relating to its submission. Bids which do not comply with the procedures indicated and described in the tender document shall be excluded from the evaluation process. Madde 6 - Bildirim ve tebligat esasları Article 6- Notification/official communication principles 6.1. Bildirim ve tebligat, iadeli taahhütlü posta yoluyla veya imza karşılığı elden yapılır. Ancak, ihale dokümanının satın alındığına ilişkin formda ve/veya teklif mektubunda elektronik posta adresinin ve/veya faks numarasının belirtilmesi ve bu adrese veya faks numarasına yapılacak bildirimlerin kabul edileceğinin taahhüt edilmesi kaydıyla, İdare tarafından elektronik posta yoluyla veya faksla bildirim de yapılabilir Notification/Official communication is made by the registered and prepaid mail or by the hand against signature. However, notification can be made through electronic mail or fax provided that electronic mail address and/or fax number are specified in the document indicating procurement of tender documents and/or it is undertaken to accept the notification to be made to this address or fax number İadeli taahhütlü mektupla yapılan tebligatta mektubun postaya verilmesini takip eden yedinci gün, yabancı isteklilerde ise ondokuzuncu gün tebliğ tarihi sayılır. Tebligatın bu tarihten önce muhataba ulaşması halinde ise fiili tebliğ tarihi esas alınır In official communication made through registered and prepaid mail, 7 th day following date on which the letter has been given to the post office and 19 th day for foreign bidders are considered notification date. If the notification arrives at the addressee before above-stipulated date and then actual notification date is accepted as basis Elektronik posta yoluyla veya faks ile yapılan bildirimlerde, bildirim tarihi tebliğ tarihi sayılır. Bu şekilde yapılan bildirimlerin aynı gün İdare tarafından teyit edilmesi zorunludur. Aksi takdirde bildirim yapılmamış sayılır. Teyit işleminin gerçekleşmiş kabul edilmesi için tebligatın iadeli taahhütlü mektupla bildirime çıkarılmış olması yeterlidir. Elektronik posta yoluyla veya faks ile yapılan bildirimler, bildirim tarihi ve içeriğini de kapsayacak şekilde ayrıca belgelenir. 4

5 6.3. If a notification is sent via or fax, the date on which the notification is sent will be the notification date. In this case, the contracting entity must make sure that the tenderer has received the notification. Otherwise the notification will be null and void. The notification delivered via registered mail is enough for the notification to be considered as valid. The notifications sent via or fax are separately documented to include the notification date and scope Elektronik posta yoluyla yapılacak bildirimler, İdarenin resmi elektronik posta adresi kullanılarak yapılır The official address of the contracting entity will be used if a notification is sent via İdare tarafından ortak girişimlere yapılacak bildirim ve tebligat, yukarıdaki esaslara göre pilot/koordinatör ortağa yapılır The notifications to joint ventures will be sent according to the above mentioned procedure to the main / coordinator tenderer İstekli olabilecekler ve istekliler tarafından İdareyle yapılacak yazışmalarda elektronik posta ve faks kullanılamaz. Ancak, bu Şartnamenin 4.1.d) maddesinde ihale dokümanının posta veya kargo yoluyla satılması hususu düzenlenmiş olması şartıyla, ihale dokümanının satın alınmasına ilişkin talepler faksla yapılabilir Potential tenderers and tenderers can t use or fax in their correspondence with the contracting entity. If the sale of tender documents via mail or courier is allowed in the article 4.1.d) of this administrative specification, the tenderers requests of tender documents may be sent via fax. II- İHALEYE KATILMAYA İLİŞKİN HUSUSLAR II- ISSUES RELATED TO PARTICIPATION IN THE TENDER Madde 7-İhaleye katılabilmek için gereken belgeler ve yeterlik kriterleri Article 7- Documents and qualification criteria required for participating in the tender 7.1. İsteklilerin ihaleye katılabilmeleri için aşağıda sayılan belgeleri teklifleri kapsamında sunmaları gerekir: 7.1. In order to participate in the tender, the tenderers have to submit the following documents in scope of their bids: a) Mevzuatı gereği kayıtlı olduğu ticaret ve/veya sanayi odası veya meslek odası belgesi; a) Certificate from the Chamber of Commerce and/or Industry or Professional Association where the tenderer is registered according to the relevant legislation. 1) Gerçek kişi olması halinde, kayıtlı olduğu Ticaret ve/veya Sanayi Odasından ya da esnaf ve sanatkârlar odasından, ilk ilan veya ihale tarihinin içinde bulunduğu yılda alınmış, odaya kayıtlı olduğunu gösterir belge, 1) Where the Tenderer is a natural person, a document obtained in the same year as the first announcement date of the tender / the tender date, confirming registration with a Chamber of Commerce and/or Industry or a Professional Association. 2) Tüzel kişi olması halinde, ilgili mevzuatı gereği kayıtlı bulunduğu Ticaret ve/veya Sanayi Odasından, ilk ilan veya ihale tarihinin içinde bulunduğu yılda alınmış, tüzel kişiliğin odaya kayıtlı olduğunu gösterir belge, 2) If the Tenderer is a legal person, a document obtained from the Chamber of Commerce and/or Industry at which the legal person is registered, confirming that the legal person was registered in the same year as the first announcement date / the tender date. b) Teklif vermeye yetkili olduğunu gösteren imza beyannamesi veya imza sirküleri; b) A Declaration of Signature or Authorized Signatory List evidencing authorization for bidding. 1) Gerçek kişi olması halinde, noter tasdikli imza beyannamesi, 1) A certificate of signature certified by a Notary Public in the case of a natural person. 2) Tüzel kişi olması halinde, ilgisine göre tüzel kişiliğin ortakları, üyeleri veya kurucuları ile tüzel kişiliğin yönetimindeki görevlileri belirten son durumu gösterir Ticaret Sicil Gazetesi, bu bilgilerin tamamının bir Ticaret Sicil Gazetesinde bulunmaması halinde, bu bilgilerin tümünü göstermek üzere ilgili Ticaret Sicil Gazeteleri veya bu hususları gösteren belgeler ile tüzel kişiliğin noter tasdikli imza sirküleri, 2) The original or a notarized copy of the Trade Registry Gazette indicating the most recent state of the shares and the duties of the shareholders in the company and an Authorized Signatory List authenticated by the Notary Public in the case of a legal person. Foreign tenderers, may submit a written pledge that they do not have any finalized debts with respect to tax payments and social security payments under the relevant provisions of the legislation of their own country, instead of the documents evidencing that they are not in the situation mentioned in sub articles (c) and (d) of the Article 10 of this specification Mesleki ve teknik yeterliğe ilişkin belgeler ve bu belgelerin taşıması gereken kriterler; 7.2. Documents related to professional and technical qualification and the Criteria to be met by these documents İstekliler, ihale tarihi itibariyle geçerli olan aşağıda belirtilen mesleki ve teknik yeterlik belgelerini teklifi ile birlikte vereceklerdir. Bu belgeler yeterlik değerlendirmesinde kullanılacaktır Tenderers shall submit the below mentioned professional and technical qualification documents, which are still valid at the date of tender, together with their offers. These documents shall be used for qualification evaluation Üretim, İmalat Kapasitesi Belgeleri Documents Relating to Production, Production Capacity a) İstekli imalatçı ise imalatçılık belgesi, a) If the tenderer is a manufacturer, manufacturing certificate. b) İstekli yetkili satıcı ise, imalatçının imalatçılık belgesi ile kendisine ait yetkili satıcılık belgesi, b) If the tenderer is an authorized dealer, the manufacturing certificate of the manufacturer and its own authorized dealer Certificate. c) Türkiye de serbest bölgelerde faaliyet gösteren imalatçı veya yetkili satıcı ise yukarıdaki belgelerin yanı sıra serbest bölge faaliyet belgesi. c) If the manufacturer or authorized dealer is operating in free zones in Turkey, along with the above documents, the free zone operation certificate Adayın veya isteklinin imalatçı olduğunu gösteren belge veya belgeler ise şunlardır: I) Aday veya istekli adına düzenlenen Sanayi Sicil Belgesi, II) Adayın veya isteklinin üyesi olduğu meslek odası tarafından aday veya istekli adına düzenlenen Kapasite Raporu, III) Adayın veya isteklinin kayıtlı olduğu meslek odası tarafından aday veya istekli adına düzenlenen İmalat Yeterlik Belgesi, IV) Adayın veya isteklinin kayıtlı olduğu meslek odası tarafından aday veya istekli adına düzenlenmiş ve teklif ettiği mala ilişkin Yerli Malı Belgesi, V) Adayın veya isteklinin alım konusu malı ürettiğine ilişkin olarak ilgili mevzuat uyarınca yetkili kurum veya kuruluşlarca düzenlenen ve aday veya isteklinin üretici veya imalatçı olduğunu gösteren belgeler. Aday veya istekliler, imalatçı olduğunu yukarıdaki belgelerden birini sunarak tevsik edebilecektir. The document(s) demonstrating that the tenderer is a manufacturer; I) Industry Registration Document issued in the name of the tenderer, II) Capacity Report issued in the name of the tenderer by the business chamber which the tenderer is a member of. III) Manufacture Adequacy Document issued in the name of the tenderer by the business chamber which the tenderer is a member of. 6

7 IV) Domestic Goods Document pertaining to the offered material, which issued in the name of the tenderer by the business chamber which the tenderer is a member of. V) The documents issued by authorized institutions in the scope of the scope of the related legislation demonstrating that the tenderer is a manufacturer or producer. The tenderers can prove that that they are manufacturers by submitting one of the documents above Kalite yönetim sistem belgesinin Türk Akreditasyon Kurumu tarafından akredite edilen belgelendirme kuruluşları veya Uluslararası Akreditasyon Forumu Karşılıklı Tanınma Antlaşmasında yer alan ulusal akreditasyon kurumlarınca akredite edilmiş belgelendirme kuruluşları tarafından düzenlenmesi zorunludur. Bu belgelendirme kuruluşlarının, Uluslararası Akreditasyon Forumu Karşılıklı Tanınma Antlaşmasında yer alan ulusal akreditasyon kurumlarınca akredite edilmiş belgelendirme kuruluşu olduklarının ve bu kuruluşlarca düzenlenen belgelerin geçerliliğini sürdürdüğünün, Türk Akreditasyon Kurumundan alınacak bir yazı ile teyit edilmesi gerekir. Confirmation letters issued on the tender date or a year before the tender date is acceptable. It is sufficient that this document is valid on the tender date. However, the translations of the documents which are issued in foreign languages must be made by a sworn translator in Turkey and must be approved by notary public. 12 d) İdarenin ihale konusu işle ilgili her türlü ihale işlemlerini hazırlamak, yürütmek, sonuçlandırmak ve onaylamakla görevli olanlar. d) Those who are assigned to prepare, execute, finalize and approve all procurement proceedings of the Contracting Entity relating to the subject of the tender. e) (c) ve (d) bentlerinde belirtilen şahısların eşleri ve üçüncü dereceye kadar kan ve ikinci dereceye kadar kayın hısımları ile evlatlıkları ve evlat edinenleri. e) Spouses, blood relatives up to the third degree, relatives of kinship by marriage up to the second degree, as well as adopted children and adopted parents of the persons mentioned in paragraphs (c) and (d). f) (c), (d) ve (e) bentlerinde belirtilenlerin ortakları ile şirketleri (bu kişilerin yönetim kurullarında görevli bulunmadıkları veya sermayesinin % 10'undan fazlasına sahip olmadıkları anonim şirketler hariç). f) The partners and the companies of the persons mentioned in paragraphs (c), (d) and (e) (except for joint stock corporations of which these persons are not on the board of directors or of which these persons do not own more than 10 % of the capital). g) 4734 sayılı Kanunun 53 üncü maddesinin (b) fıkrasının 8 inci alt bendi gereğince alınacak Bakanlar Kurulu Kararları ile belirlenen yabancı ülkelerin isteklileri. g) Tenderers from the countries set out in the Decision of the Council of Ministers made according to subparagraph 8, paragraph (b), Article 53 of Law Number İhale konusu alımla ilgili danışmanlık hizmetlerini yapan yükleniciler bu işin ihalesine katılamazlar. Ayrıca, bu durumun tekliflerin değerlendirmesi aşamasında tespit edilememesi nedeniyle bunlardan biri üzerine ihale yapılmışsa teminatı gelir kaydedilerek ihale iptal edilir Tenderers who take part in the tender in spite of these restrictions will be excluded from the tender and their preliminary guarantee will be seized as income. Furthermore, in the case that the tender is awarded to one of these tenderers due to the fact that it is not detected at the stage of evaluation of the bids, their guarantee will be seized and the tender cancelled. Madde 10-İhale dışı bırakılma nedenleri Article 10- Reasons for Being Excluded from the Tender Aşağıda belirtilen durumlardaki istekliler, bu durumlarının tespit edilmesi halinde, ihale dışı bırakılacaktır; Tenderer shall be excluded from the tender proceedings where they are determined to be in the following situations; a) İflas eden, tasfiye halinde olan, işleri mahkeme tarafından yürütülen, konkordato ilân eden, işlerini askıya alan veya kendi ülkesindeki mevzuat hükümlerine göre benzer bir durumda olan. a) those going bankrupt or being liquidated, whose affairs are being administered by the court, who have announced an arrangement with creditors, who have suspended business activities or who are in a similar situation under their own national laws and regulations. b) İflası ilân edilen, zorunlu tasfiye kararı verilen, alacaklılara karşı borçlarından dolayı mahkeme idaresi altında bulunan veya kendi ülkesindeki mevzuat hükümlerine göre benzer bir durumda olan. b) those whose bankruptcy is declared, who are the subject of an order of compulsory liquidation, or are under court administration due to debts to creditors, or who are in a similar situation under their own national laws and regulations. c) Türkiye'nin veya kendi ülkesinin mevzuat hükümleri uyarınca kesinleşmiş sosyal güvenlik prim borcu olan. c) those having finalized debts with respect to social security payments in accordance with the relevant provisions of the legislation of Turkey or their own country. d) Türkiye'nin veya kendi ülkesinin mevzuat hükümleri uyarınca kesinleşmiş vergi borcu olan. d) those having finalized debts with respect to tax payments in accordance with the relevant provisions of the legislation of turkey or their own country. e) İhale tarihinden önceki beş yıl içinde, mesleki faaliyetlerinden dolayı yargı kararıyla hüküm giyen. e) Those who have been convicted by a court in connection with their professional activities during a period of five (5) years prior to the date of the Tender. f) İhale tarihinden önceki beş (5) yıl içinde, idareye yaptığı işler sırasında iş veya meslek ahlakına aykırı faaliyetlerde bulunduğu idare tarafından ispat edilen. f) those who have been proven by a Contracting Entity to have performed activities in violation of business or professional ethics in works realized for the latter during a period of five (5) years prior to the date of the Tender. 12

13 g) İhale tarihi itibariyle, mevzuatı gereği kayıtlı olduğu oda tarafından mesleki faaliyetten men edilmiş olan. g) those that have been prohibited from professional activities by the chamber which they are registered with according to the provisions of the related legislation as of the date of the Tender. h) Bu şartname ile İdare tarafından istenen bilgi ve belgeleri vermeyen veya yanıltıcı bilgi ve/veya sahte belge verdiği tespit edilen. h) those who have not submitted the information and documents required by the Contracting Entity under this Specification or those who have been established to have submitted misleading or fake information/documents. i) Şartnamenin 9 uncu maddesinde ihaleye katılamayacağı belirtildiği halde ihaleye katılan. i) Those who have participated in the tender although it was stated in Article 9 of this Specification that they cannot. j) Şartnamenin 11 inci maddesinde belirtilen yasak fiil veya davranışlarda bulunduğu tespit edilen. j) Those who are established to be involved in prohibited acts and conduct as laid down in Article 11 of this Specification. NOTE: The document concerning articles (a), (b) and (g) shall be requested under the title of Tender State Document from related Chamber of Commerce or Chamber of Industry. The document concerning article (e); - If requested for real person belonging to real person himself - If requested for juristic person I- Belonging to members of the board of directors in joint-stock companies II- Belonging to the director of the company or if it doesn t exist belonging to each and every partner of the company in limited companies. III- Belonging to all commandite partners and to the ones having the authority to present the company in commandite companies. Madde 11- Yasak fiil veya davranışlar Article 11- Prohibited acts and conduct İhale süresince aşağıda belirtilen fiil veya davranışlarda bulunmak yasaktır: The following acts and conduct are prohibited in tender proceedings: a) Hile, vaat, tehdit, nüfuz kullanma, çıkar sağlama, anlaşma, irtikap, rüşvet suretiyle veya başka yollarla ihaleye ilişkin işlemlere fesat karıştırmak veya buna teşebbüs etmek. a) To conduct or attempt to conduct procurement fraud by means of fraudulent and corrupt acts, promises, threats, unlawful influence, undue interest, agreement, corruption, bribery or other actions. b) İsteklileri tereddüde düşürmek, katılımı engellemek, isteklilere anlaşma teklifinde bulunmak veya teşvik etmek, rekabeti veya ihale kararını etkileyecek davranışlarda bulunmak. b) To cause confusion among tenderers, to prevent participation, to offer agreement to tenderers or to encourage tenderers to accept such offers, to undertake actions which may influence competition or the tender decision. c) Sahte belge veya sahte teminat düzenlemek, kullanmak veya bunlara teşebbüs etmek. c) to issue or use fake documents or securities or to attempt to do so. d) İhalede; Alternatif teklif verebilme halleri dışında, bir istekli tarafından kendisi veya başkaları adına doğrudan veya dolaylı olarak, asaleten ya da vekaleten birden fazla teklif vermek. d) except for being able to propose alternative bids, submission of more than one tender by a tenderer on his own account or on behalf others, directly or indirectly, in his own name or in the name of others. 13

14 e) Şartnamenin 9 uncu maddesinde ihaleye katılamayacağı belirtildiği halde ihaleye katılmak. e) Participating in the tender although it was stated in Article 9 of this Specification that they cannot Bu yasak fiil veya davranışlarda bulunanlar hakkında fiil veya davranışın özelliğine göre 4734 sayılı Kanunun Dördüncü Kısmında belirtilen hükümler uygulanır The provisions stipulated in Section Four of the Public Procurement Law number 4734, depending on the type of the prohibited act or conduct, will be applied to those who have carried out these prohibited acts and actions. Madde 12- Teklif hazırlama giderleri Article 12- Tender preparation expenses Tekliflerin hazırlanması ve sunulması ile ilgili bütün masraflar isteklilere aittir. İstekli, teklifini hazırlamak için yapmış olduğu hiçbir masrafı İdareden isteyemez. Tenderer shall be responsible for all of the expenses incurred in connection with preparing and submitting bids. The Contracting Entity cannot be held responsible with regard to the expenses born by the tenderer, regardless of the course and result of the tender. Madde 13- İhale dokümanına ilişkin açıklama yapılması Article 13- Explanations of the Tender Document İstekliler, tekliflerin hazırlanması aşamasında, ihale dokümanında açıklanmasına ihtiyaç duydukları hususlarla ilgili olarak, son teklif verme gününden oniki (12) gün öncesine kadar yazılı olarak açıklama talep edebilirler. Bu tarihten sonra yapılacak açıklama talepleri değerlendirmeye alınmayacaktır Tenderers may request written clarification of the tender document for such issues as they judge necessary until at the latest twelve (12) days prior to the deadline for submittal of bids. Requests made after this date shall not be considered Açıklama talebinin uygun görülmesi halinde, idarece yapılacak açıklama, bu tarihe kadar ihale dokümanı alan tüm isteklilere yazılı olarak mektupla gönderilir veya imza karşılığı elden verilir. İdarenin bu yazılı açıklaması, son teklif verme gününden en az beş (5) gün önce tüm isteklilerin bilgi sahibi olmalarını sağlayacak şekilde yapılacaktır Where such a request is deemed appropriate by the Contracting Entity, the clarifications and explanations to be made by the Contracting Entity shall be sent in writing through registered mail or may be hand-delivered against signature, to all tenderers who have already acquired the tender documents by that date. The written explanation of the Contracting Entity will be sent in a timely manner so as to ensure that all tenderers will have been informed at the latest five (5) days before the bidding date Açıklamada, sorunun tarifi ve idarenin ayrıntılı cevapları yer alır; ancak açıklama talebinde bulunan isteklinin kimliği belirtilmez The explanation will contain the description of the problem and the detailed answers of the Contracting Entity; the identity of the tenderer who has made the request shall not be disclosed Yapılan yazılı açıklamalar, ihale dokümanını açıklamanın yapıldığı tarihten sonra alan isteklilere ihale dokümanının bir parçası olarak verilir Complementary or supplementary explanations will be included as an annex to the tender document for those tenderers who purchase the tender document after the explanation has been made. Madde 14- İhale dokümanında değişiklik yapılması Article 14- Amendments to the Tender document İlan yapıldıktan sonra ihale dokümanında değişiklik yapılmaması esastır. Ancak, ilan yapıldıktan veya teklif istenildikten sonra ilanlarda, şartnamelerde ve eklerinde değişiklik yapılması zorunlu olduğunun idarece tespit edilmesi veya isteklilerce yazılı olarak bildirilmesi hallerinde, zeyilname düzenlenmek suretiyle İdarece, ihale dokümanında değişiklik yapılabilir ve son durum gerekirse yeniden ilan edilir. Zeyilname, ihale dokümanının bağlayıcı bir parçası olarak ihale dokümanına eklenir In principle, no amendments should be made in the tender documents after the advertisement of the tender notice. However, after the advertisement of the tender notice and after the request of bid, if the Contracting Entity determines that it is obligatory to make the amendments in the specification and its annexes or it is notified by tenderers in writing, the tender documents can be amended by issuing an addendum. Addendums are annexed to the tender document as a binding section Zeyilname, ihale dokümanı alanların tümüne mektup yoluyla gönderilir veya imza karşılığı elden verilir ve ihale tarihinden en az beş (5) gün önce bilgi sahibi olmaları sağlanır The addendum will be sent to those who have purchased tender documents through registered mail, or may be hand-delivered against signature, and it will be ensured that all tenderers are notified at the latest five (5) days prior to the bidding date Yapılan değişiklik nedeniyle tekliflerin hazırlanabilmesi için ek süreye ihtiyaç duyulması halinde, idare ihale tarihini bir defaya mahsus olmak üzere en fazla yirmi (20) gün süreyle zeyilname ile erteleyebilir. Erteleme süresince ihale dokümanı satılmasına ve teklif alınmasına devam edilir In the case that the need for a time extension arises as a result of the amendment, the Contracting Entity can, on a one-off basis, postpone the bidding date for twenty (20) days with an addendum. Selling the tender documents and receiving the offers within the postponed period will continue. 14

15 14.4. Zeyilname düzenlenmesi halinde, teklifini bu düzenlemeden önce vermiş olan isteklilere tekliflerini geri çekerek, yeniden teklif verme imkanı tanınacaktır In case an addendum is issued, tenderers who have submitted their bids prior to this arrangement shall be given the opportunity to withdraw their bids and resubmit them. Madde 15-İhale saatinden önce ihalenin iptal edilmesinde idarenin serbestliği Article 15- Discretion of the Contracting Entity to Cancel the Tender Prior to the Hour for the Receipt of Tenders İdarenin gerekli gördüğü veya ihale dokümanında yer alan belgelerde ihalenin yapılmasına engel olan ve düzeltilmesi mümkün bulunmayan hususların bulunduğunun tespit edildiği hallerde, ihale saatinden önce ihale iptal edilebilir The tender may be cancelled prior to its hour in cases where considered necessary by the Contracting Entity or where it is established that the documents included in the tender documents contain items preventing the performance of the tender which are impossible to correct Bu durumda, iptal nedeni belirtilmek suretiyle ihalenin iptal edildiği isteklilere ilan edilerek duyurulur. Bu aşamaya kadar teklif vermiş olanlara ihalenin iptal edildiği ayrıca tebliğ edilir Tenderers will be individually notified of the cancellation of the tender, with the reasons for the cancellation stated. Those who have already submitted their bids shall be notified of the cancellation separately İhalenin iptali halinde, verilmiş olan bütün teklifler reddedilmiş sayılır ve bu teklifler açılmaksızın isteklilere iade edilir In case of the cancellation of the tender, all bids that have already been submitted shall be considered rejected and these bids shall be returned to the tenderers unopened İhalenin iptal edilmesi nedeniyle isteklilerce idareden herhangi bir hak talebinde bulunulamaz The tenderer cannot make any claims against the Contracting Entity because of the cancellation of tender proceedings. Madde 16-Konsorsiyum Article 16- Consortia Konsorsiyumlar ihaleye teklif veremez Consortia cannot submit tenders for this procurement. Madde 17-Alt yükleniciler Article 17- Subcontractors İhale konusu alımın/işin tamamı veya bir kısmı alt yüklenicilere yaptırılamaz The undertaking that is subject of the tender cannot be assigned as a whole or in part to subcontractors. III. TEKLİFLERİN HAZIRLANMASI VE SUNULMASINA İLİŞKİN HUSUSLAR Madde 18 Teklif ve sözleşme türü Article 18- Type of tender and contract III. ISSUES PERTAINING TO THE PREPARATION AND SUBMISSION OF BIDS İstekliler tekliflerini, her bir iş kaleminin miktarı ile bu iş kalemleri için teklif edilen birim fiyatlarının çarpımı sonucu bulunan toplam bedel üzerinden vereceklerdir. İhale sonucu, ihale üzerine bırakılan istekliyle her bir iş kaleminin miktarı ile iş kalemleri için teklif edilen birim fiyatların çarpımı sonucu bulunan toplam bedel üzerinden birim fiyat sözleşme imzalanacaktır The tenderers shall submit their tenders over the total amount calculated by multiplying the quantity of each item with the unit prices proposed for corresponding items. Unit price contract shall be concluded with the tenderer that is awarded the contract as a result of the procurement process over the total amount calculated by multiplying the quantity of each item with the unit prices proposed for corresponding items Madde 19-Kısmi teklif verilmesi Article 19- Partial Offers İhale konusu işe ilişkin kısmi teklif verilebilir Partial offer shall be submitted for the work which is the subject of the tender Kısmi teklif verilmesi halinde teklif verilecek kalemlerdeki miktarın tamamı için teklif verilecektir In case of submitting partial offer, the offer shall be submitted for entire quantity of the items for which the offer is submitted. 15

16 Madde 20- Alternatif teklifler Article 20- Alternative Bids İhale konusu işe ilişkin olarak alternatif teklif verilemeyecektir. No alternative bid shall be submitted for the work, which is the subject of the tender. Madde 21-Teklif ve ödemelerde geçerli para birimi Article 21- Valid currency with regard to the bid and payments Yerli istekliler, Türk Lirası veya EURO veya konvertible döviz cinsinden teklif verebileceklerdir. Döviz bazında teklif veren yerli isteklilerin ödemeleri sözleşmede belirtildiği şekilde TL olarak yapılacaktır. Yabancı isteklilerce, EURO veya konvertible döviz cinsinden verilen ve akreditifli ödeme biçimini içeren tekliflerin ödemeleri sözleşmede belirtildiği şekilde teklif para cinsinden yapılacaktır Domestic tenderers may submit their bids over TL or EURO or convertible foreign exchange. The payments of the domestic tenderers who submit their bids over foreign exchange shall be made over Turkish Liras (TL) as indicated in the contract. The payments of the offers submitted by the foreign tenderers over convertible foreign exchange or EURO and including the payment method through the letter of credit shall be made over the currency in the offer as indicated in the contract. Madde 22-Tekliflerin sunulma şekli Article 22-Format for submitting the Bid Teklif Mektubu ve geçici teminat da dahil olmak üzere ihaleye katılabilme şartı olarak bu şartnamede istenilen bütün belgeler bir zarfa veya pakete konulur. Zarfın veya paketin üzerine isteklinin adı, soyadı veya ticaret unvanı, tebligata esas açık adresi, teklifin hangi işe ait olduğu ve ihaleyi yapan idarenin açık adresi yazılır. Zarfın yapıştırılan yeri istekli tarafından imzalanarak, mühürlenir veya kaşelenir As a necessary condition for participation in the tender, the bidding letter and all documents, including the preliminary guarantee, requested in this present Specification shall be placed in an envelope. The name, surname or the trade name, open address for notifications, the subject of the tender and the address of the Contracting Entity shall be written on the envelope. The seal of the envelope shall be sealed or stamped by signing by the tenderer Teklifler ihale dokümanında belirtilen ihale saatine kadar sıra numaralı alındılar karşılığında idareye (tekliflerin sunulacağı yere) teslim edilir. Bu saatten sonra verilen teklifler kabul edilmez ve açılmadan istekliye iade edilir. Bu durum bir tutanakla tespit edilir Bids shall be submitted to the Contracting Entity (location for submittals) up until the time specified in the tender documents, in return for consecutively numbered receipts. Bids submitted after the time specified as the deadline shall not be accepted and shall be returned unopened. This event is recorded by a memorandum Teklifler iadeli taahhütlü olarak posta ile de gönderilebilir. Posta ile gönderilecek tekliflerin ihale dokümanında belirtilen ihale saatine kadar idareye ulaşması şarttır. Postadaki gecikme nedeniyle işleme konulmayacak olan tekliflerin alınış zamanı bir tutanakla tespit edilir ve değerlendirmeye alınmaz Bids can be sent through registered mail. Tenders sent by mail should reach the Contracting Entity by the time specified as the deadline in the tender documents. The time of receipt of bids that will not be considered in the tendering proceedings due to delays in the post will be recorded in a minutes and they will not be evaluated Verilen teklifler, bu Şartname hükümlerine göre zeyilname düzenlenmesi hali hariç, herhangi bir sebeple geri alınamaz ve değiştirilemez Bids submitted cannot be withdrawn or changed for any reason except the issuing of an addendum under the provisions of this Specification Zeyilname ile teklif verme süresinin uzatılması halinde, idare ve isteklilerin ilk teklif verme tarihine bağlı tüm hak ve yükümlülükleri süre açısından, yeniden tespit edilen son teklif verme tarihine ve saatine kadar uzatılmış sayılır In case of a time extension for submitting bids due to an addendum, all rights and obligations of the Contracting Entity and those of the tenderers in connection with the initial submittal date shall be deemed as extended until the last bidding deadline and time that is re-determined. Madde 23-Teklif mektubunun şekli ve içeriği Article 23-The Form and Content of the Letter of Bid Teklif mektupları, ekteki form örneğine uygun şekilde yazılı ve imzalı olarak sunulur The letters of bid will be submitted in writing and with a signature in accordance with the sample form attached as annex Teklif Mektubunda; a) İhale dokümanının tamamen okunup kabul edildiğinin belirtilmesi, teknik şartnamesinde belirtilmesi halinde, teknik şartnamedeki tüm maddelere ayrı ayrı cevap verilmesi, b) Teklif edilen bedelin rakam ve yazı ile birbirine uygun olarak açıkça yazılması, c) Kazıntı, silinti, düzeltme bulunmaması, ç) Türk vatandaşı gerçek kişilerin Türkiye Cumhuriyeti kimlik numarasının, Türkiye de faaliyet gösteren tüzel kişilerin ise vergi kimlik numarasının belirtilmesi, 16

17 d) Teklif mektubunun ad, soyadı ve ticaret unvanı yazılmak suretiyle yetkili kişilerce imzalanmış olması, zorunludur In the letter of bid; a) It should be stated that the tender document has been fully read and accepted and if it is indicated in the technical specification, all of the articles in therein should be answered individually. b) The amount of the bid should be clearly written in letters and numbers that correspond to each other, c) There should be no erasure, deletion, or correction to it, ç) National identity numbers of the natural persons who are Turkish citizens and tax ID numbers of legal persons acting in Turkey must be indicated, d) The bidding letter should be duly signed by authorized persons mentioning his/her name, surname and trade name. Madde 24- Tekliflerin geçerlilik süresi Article 24- Validity Period of the Bid Tekliflerin geçerlilik süresi, ihale tarihinden itibaren 60 (altmış) takvim günüdür. Bu süreden daha kısa süreli teklif mektupları değerlendirmeye alınmayacaktır The period of validity for bids should be a minimum of 60 (sixty) calendar days starting from the Tender date. Bidding letter with a period of validity shorter than the mentioned period shall not considered for the evaluation İhtiyaç duyulması halinde idare teklif geçerlilik süresi sona ermeden, teklif geçerlilik süresinin en fazla yukarıda belirtilen süre kadar uzatılması yönünde isteklilerden talepte bulunabilir. İstekliler, idarenin bu talebini kabul edebilir veya reddedebilir. İdarenin teklif geçerlilik süresi uzatılması talebini reddeden isteklinin geçici teminatı iade edilecektir When needed the Contracting Entity may, before the expiry of the validity period of the bids, request from the tenderer an extension of the validity period of the bid for a maximum of the period set out above. The tenderer is free to accept or refuse this request of the Contracting Entity. IV-TEKLİFLERİN DEĞERLENDİRİLMESİ VE SÖZLEŞME YAPILMASINA İLİŞKİN HUSUSLAR IV- EVALUATION OF BIDS AND ISSUES PERTAINING TO THE CONTRACT Madde 30-Tekliflerin alınması ve açılması Article 30- Receipt and Opening of the Tender Teklifler ihale dokümanında belirtilen ihale saatine kadar İdareye verilir. İhale komisyonunca ihale dokümanında belirtilen saatte kaç teklif verilmiş olduğu bir tutanakla tespit edilerek, hazır bulunanlara duyurulur ve hemen ihaleye başlanır. İhale komisyonu teklif zarflarını alınış sırasına göre inceler. Şartnamenin maddesine uygun olmayan zarflar bir tutanak ile belirlenerek değerlendirmeye alınmaz. Zarflar isteklilerle birlikte hazır bulunanlar önünde alınış sırasına göre açılır The bids are be submitted to the Contracting Entity by the deadline bidding time mentioned in this Specification. The number of the bids submitted by the deadline bidding time indicated in this Specification is specified by the Tender Commission with minutes, and it is announced to the audience and the tender will start. The tender commission examines the tender envelopes in the order they were received. Envelopes that do not meet the requirements of Article 22.1 of this specification are specified with a minutes and consequently excluded from the evaluation process. Teklifler ihale komisyonunca hemen değerlendirilmek üzere oturum kapatılır A control is carried out as to whether the documents of the tenderers are complete and whether the letter of bid and the preliminary guarantee conform to the procedures. Tenderers whose documents are not complete or whose letter of bid and preliminary guarantee do not conform to the procedures are recorded in a minutes. The tenderers and their bid prices are announced. The minutes issued for these procedures is signed by the tender commission. A decision with regard to the rejection or acceptance of the bid is not made at this stage; the documents constituting the bid cannot be corrected or completed. The session is closed for the tender commission to evaluate the tenders immediately. Madde 31-Tekliflerin değerlendirilmesi Article 31- Evaluation of the tenders Tekliflerin değerlendirilmesinde, öncelikle belgeleri eksik olduğu veya teklif mektubu ile geçici teminatı usulüne uygun olmadığı bu Şartnamenin 29 uncu maddesine göre ilk oturumda tespit edilen isteklilerin tekliflerinin değerlendirme dışı bırakılmasına karar verilir. Ancak teklifin esasını değiştirecek nitelikte olmaması kaydıyla, belgelerin eksik olması veya belgelerde önemsiz bilgi eksikliği bulunması halinde, idarece belirlenen sürede isteklilerden bu eksik belge veya bilgilerin tamamlanması yazılı olarak istenir. Belirlenen sürede eksik belge veya bilgileri tamamlamayan istekliler değerlendirme dışı bırakılır The first decision during the evaluation process for the bids relates to the exclusion of bids according to Article 29 of this Specification due to incomplete documents or non-conformity of bids and preliminary guarantees to the procedures that were determined in the first session.
