4 Foreword Önsöz ÖNSÖZ FOREWORD Bilgi ve bilişim toplumunda istatistiğin evrensel bir konuşma dili hâline geldiği bilinmektedir. Ulusul ve uluslararas stratejik hedeflerin belirlenmesi ve bu hedeflerin başar s n n ölçülmesinde doğru, güncel ve güvenilir istatistiklere ihtiyaç duyulmaktad r. Günümüzde bilginin doğru yorumlanmas nda ve karar alma sürecinde, gerek araşt rmac lar n gerekse karar al c lar n çal şmalar nda, istatistikî verileri etkin olarak kulland klar görülmektedir. It is known that statistic has been a global spoken language in information society. Correct, current and reliable statistical datas are needed in order to determine national and international objectives and to measure success of these objectives. It is seen that at present time both researchers and decision makers use statistical datas effectively during the decision making process and interpreting of information truly.. Genel Müdürlüğümüzce, Resmî İstatistik Program na göre değişkenler belirlenerek verilerin toplanmas suretiyle elde edilen güvenilir, tarafs z, kaliteli, standartlara uygun, k yaslanabilir, tutarl ve zamanl verilerle istatistikî bilgi kaynağ oluşturularak karar al c lara yol gösterilmesi hedeflenmiştir. It has been aimed to guide decision makers by creating reliable, impartial, quality, in accordance with standarts, comparable, consistent and well-timed information source by our Directorate General through collecting datas by determining variables according to the Official Statistics Programme. Judicial Statistics consist of datas compiled from the analysed digital data,collected systematically according to decisions of Constitutional Court, the Supreme Court, the Council of State, the Court of Jurisdictional Disputes, the Military Supreme Court, the Military High Administration Court, the Ministry of National Defence Military Justice Affairs Department, High Arbitration Committee, Turkish Notary Public Union, Council of Forensic Medicine and properties of parties. Genel Müdürlüğümüz, her y l düzenli olarak ç karm ş olduğu Adalet İstatistikleri yay n ile, mevcut aksakl k ve eksikliklerin tespiti ve bunlar n giderilmesinde, k sa ve uzun vadeli stratejik plân, program ve projelerin yap lmas nda, otuz beş y ll k tecrübesiyle yarg ya ilişkin istatistik hizmeti vermek suretiyle öncü rol üstlenmiştir. Günümüzde bakanl klar n artan ve değişen talepleri, yeni bakanl klar n kurulmas ve faaliyet plânlamalar nda birçok istatistikî veriye ihtiyaç duymalar, keza Avrupa Birliğine uyum sürecinde yeni uluslararas kurum ve kuruluşlar n oluşmas ve bunlar n birçok ayr nt y kapsayan istatistikî veri istemeleri karş s nda, istatistik birimi giderek daha önemli bir hâl alm şt r. With the annually published "Judicial Statistics" book our Directorate General has been a pioneer in determination and elimination of curent troubles and deficiencies, making long and short term strategical plan, programme and projects by providing judicial statstic service with it's thirthy five years experience. Nowadays statistical unit has become important with increasing and changing demands of ministries, establisment of new ministries and their need of statistical data in their activity repeort, likewise establishment of new institutions and organizations with the process of adaptation to the Eropean Union and their need for detailed statistical data. Gelişen dünya ve bilgi toplumu, çağ n gerekliliklerini yerine getirmek ad na yapt ğ araşt rmalarda istatistik biliminden faydalanmaktad r. Notion of "information society" comes into prominence in the development of golbalisation which is one of the important facts of today's world. Developing world and information society utilise "statistic" science in order to supply requirments of the time. Belirli bir alana ilişkin sonuç ç karmak ve buna bağl olarak plân ve düzenleme yapmak için adlî, idarî, malî, kültürel, bilimsel ve toplumsal alanlarda toplanan verilerin s n fland r lmas, çözümlenmesi ve yorumlanmas nda istatistiğin büyük önem arz ettiğini ve bu niteliği ile bilgi toplumunun yolunu ayd nlatt ğ n söyleyebiliriz. We can say that categorization of datas which is collected from judicial, administrative, financial,cultural,scientific and social fields to make inferences concerning to a special field and make plan and regulation accordingly has importance and leads the way of information society. This relaitonship between statistic and information society necessiates to follow change and developments in justice area in the perspective of statistic. Numeric data of acts which constitute a crime and countable proofs of other cases and applications which is related to justice are the basis of judicial statistics. Genel Müdürlüğümüz, Bakanlar Kurulu karar uyar nca haz rlanan Resmî İstatistik Program na uygun değişkenleri belirleyerek, verilerin toplanmas, s n fland r lmas ve yorumlanmas yla ortaya konulan güncel, güvenilir istatistiklerle adalet teşkilât n n etkinliği ve verimliliğinin artt r lmas ve geleceğe yönelik belirsizliğin azalt l p kabul edilebilir seviyeye getirilmesinde önemli bir görev üstlenmiştir. Our Direcotrate General takes an active role in collecting data, classifying and interpreting this data and with currenct and reliable statistics increasing the effectiveness and productivity of judicial organization by determining variables which is suitable fo Official Statistic Programme. Bu göstergelerin hesaplanmas nda kullan lan verilerin önemli bir k sm n adalet istatistiklerinde bulmak mümkündür. Adalet istatistikleri yay n, adli birimlere ait verileri, yarg daki davalar n seyri ile suç ve suçluluk hareketleri ve ülke genelindeki dağ l m n, davalardaki karar türlerini, san k, müşteki, mağdur ve taraflara ilişkin bilgileri içermektedir. In order to form future within the course of needs, the past should be analysed well in our country, like in the other countries of the world. It is an undeniable fact that, to overcome deficiencies and shortcomings in the operation of our law system, to make future plans and programmes in the process of new projects, people need some indicators related to that field. It is possible to find significant part of these data used to account these indicators in judicial statistics. Judicial statistics contains data on supreme courts, course of cases, crime and criminality trends and their distribution on the country level, information on decision types, accused persons, complainants, victims and parties in cases. 2. Tarihçe 2. Background Adli istatistik verileri, Adalet Bakanl ğ Ceza İşleri Genel Müdürlüğü'ne bağl şube müdürlüğü taraf ndan derlenmekte iken, bu görev 1979 y l nda kurulan Adli Sicil ve İstatistik Genel Müdürlüğü'ne verilmiş ve ilk kez 1982 y l nda adalet istatistikleri y ll ğ kapsam nda yay mlanm şt r. In 1986, an agreement was reached on data exchange between General Directorate and State Institute of Statistics. Therefore, General Directorate compiled data from courts, Public prosecutors' offices and enforcement directorates and published yearly. The data were also given to the Institute. With the various and increasing request of information and with the influence of the current legislation, the statistical forms have been revised, new forms have been developed and the content of publication has constantly been widened. The responsibility of data compilation and publication belonging to the publication "Judicial Statistics" being published by Turkish Statistical Institute in accordance with Official Statistics Programme abbreviated as RIP and implemented after being published in the Official Gazzette dated and numbered prepared on the basis of Turkish Statistics Law No has been set upon the Ministry of Justice General Directorate of Judicial Record and Statistics. Accordingly, as of 2006, the publication "Judicial Statistics" is being prepared by General Directorate of Judicial Record and Statistics in cooperation with Turkish Statistical Institute. XVII

Data compiling method: In the year 2008 and before, the information belonging to Public prosecutors' offices, judicial and administrative courts, Enforcement Directorates were compiled by mail through complete count method and published yearly on the web and in printed form by the General Directorate after edit-coding process on data, data recording, analysis and reporting. The information concerning courts, Public Prosecutors' Offices and Enforcement Directorates is also present within the content of National Judiciary Network Project (UYAP) being implemented by the Ministry of Justice. Therefore, as of 2009, the information in the Judicial Statistics Publication have been obtained on the basis of judicial unit records existent in National Judiciary Network database. Differences have occured in the description of certain data due to this change in data-compilation method in 2009 in comparison with previous years. Therefore, this condition needs to be taken into consideration in the comparison of the data with the previously present data. For example; while one type of case used to be counted in the file of principal in criminal and civil courts in the year 2008 and before, all types of cases have been counted in the file of principal in the year Further more, the information belonging to the number of accused persons upon whom a judicial fine along with imprisonment was imposed has been assessed altogether. The Constitutional Court: The Constitutional Court reviews the constitutionality of laws, government decrees with the power of law and the by-laws of the Turkish Grand National Assembly (Constitution, Art. 148). The Supreme Court: The Supreme Court is the court of last instance for reviewing the decisions and verdicts rendered by courts of law and in matters not referred by law to other courts of law. It has first and final jurisdiction in specific cases defined by law (Constitution, Art. 154). The Council of State: The Council of State is the court of last instance for reviewing the decisions and verdicts rendered by administrative courts and in matters not referred to other courts of administration by law. It has first and final jurisdiction in specific cases defined by law. The Council of State hears and settles administrative disputes and suits; expresses opinions on draft laws submitted by the Prime Minister and Council of Ministers; examines draft regulations, specifications and contracts of consessions; and discharges other duties as prescribed by law (Constitution, Art. 155). The Military Supreme Court: The Military Supreme Court is the court of the last instance to review decisions and verdicts rendered by military courts. Furthermore, it hears specific cases as a court of the first and last instance involving military matters as prescribed by law (Constitution, Art. 156). The Military High Administrative Court: The Military High Administrative Court is the court of the first and the last instance to review disputes appeared by administrative procedures related to the military service and military person even if it is caused by the nonmilitary authorities (Constitution, Art. 157). The Court of Jurisdictional Disputes: The Court of Jurisdictional Disputes is empowered to settle disputes among juridical, administrative, and military courts arising from disagreements on jurisdictional matters and verdicts (Constitution, Art.158). Turkish Criminal Code No. 5237, art. 32/1: A penalty shall not be imposed on a person who, due to mental disorder, cannot comprehend the legal meaning and consequences of the act he/she has committed, or if, in respect of such act, his/her ability to control his/her own behaviour is significantly diminished. However, security measures shall be imposed for such persons. Fight Against Terrorism Law, art. 10: Paragraph 6 of article 105 of the Law numbered 6352 and dated and clauses of CCP numbered 5271 were abolished dating from , article 75 of the Law numbered 6352 and article 10 of LFAT were recomposed and Chief Public Prosecutors' Offices and High Criminal Courts are assigned with article 10 of LFAT. High Criminal Court, assigned by article 10 of Fight Against Terrorism Law: Cases filed related with the offences which is under the scope of Fight Against Terrorism Law are taken to process in Aggravated Felony Courts appointed at provinces (where the judicial environment contains more than one province) determined by Supreme Council of Judges and Public Prosecutors. The president and members of these courts cannot be appointed to courts or tasks other than these by the judical committee (the Law No. 3713, Art. 10). Judgements pertaining to persons who will be judged by Constitutional Court and Supreme Court and judgements pertaining to jurisdictions of Military Courts are reserved. In addition, these courts are assigned to deal with some offences defined under special laws. Chief Public Prosecutors' Office assigned by article 10 of Fight Against Terrorism Law: Investigation for the offences covered under article 10 are executed by the public prosecutors who are appointed by the Supreme Council of Judges and Prosecutors in order to carry out investigations and prosecutions of such offences. Public Prosecutors cannot be appointed to courts or tasks other than aggravated felony courts dealing with offences covered by article 10 (the Law No. 3713, Art. 10). It can be said that there is decrease in number of aforementioned crime because of amendment made in 5941 numbered Law on Cheque, 6273 numbered Law on Cheque, which turns the crime drawing kite cheque into administrative fine.
