1 Framework for Environmental Assessment Procedures for Energy Transmission System Projects Financed by World Bank in Turkey (Revised Date: ) 1. Introduction Under ECSEE (formerly SEEREM), the power transmission component will consist mainly of rehabilitation of existing power lines and existing substations, and the installation of new 154 kv power lines, new 380 kv power lines, new 154 kv and 380 kv substations. The Energy Transmission Systems will be installed in accordance with the Turkish Legislation (regarding protective areas, wetlands, farmlands, etc.). The procedures presented in this Framework Document detail actions, which will be taken to ensure compliance with Turkish Environmental Regulations and Procedures (Turkish Regulations listed on Page.12 of this framework document) and the World Bank Environmental Assessment (EA) Policies and Procedures as specified in the World Bank Operational Policy OP/BP/GP 4.01 (Environmental Assessment). The procedures consist of the following ten elements, which address both design/construction and operational aspects: Design/Construction Phase Project Screening EA Documentation/Document Content Consultation EA Review and Approval Disclosure Implementation Conditions/Obligations Environmental Standards/Guidelines Licensing and Permitting 1

2 Implementation Phase Institutional arrangements for environmental management Reporting Descriptions for the above elements, basically the procedures, which will be followed, are presented below. 2. Design/Construction Phase 2.1. Project Screening The planning and design of power transmission lines are under the responsibility of TEIAS General Directorate, Department of Electric Transmission Lines Project Design. This department identifies the corridor for the project right-of-way and establishes a project design, which will be the basis for the implementation tender of the project. During the determination of the project right-of-way, the correspondences with the Ministry of Culture and Tourism are done whether there is any cultural or natural asset within the corridor of the project right-of-way. If it is advised by the Ministry of Culture and Tourism, the routing or location of the project is adjusted accordingly to safeguard the cultural or natural asset. The Environment Estate and Expropriation Directorate of TEIAS decides and coordinates the requirement of a Category A or Category B decision in accordance with the World Bank requirements after meeting all Turkish Requirements which include obtaining the EIA Certificate from MoEF as being requirement of No on Turkish EIA Regulation. According to Turkish EIA Regulation (Annex.1 Projects in the Regulation) a full EIA report and process (that is the classification equivalent to the EA requirements of the World Bank for a Category A project) is required for the power transmission line projects of 154 kv or above that has a length of more than 15 km, including transformer stations or switchyards as a part of the project. 2

3 Annex 2 of the Turkish EIA Regulation lists the projects where a Project Information File (Project Information File is the simpler form of an Environmental Impact Assessment report summarizing the main characteristics of the project, project location and proposed mitigation measures) is required by the MoEF in order to screen these projects, that is to decide if a full EIA is necessary or not. This Annex includes power transmission lines of 154 kv voltage and more, which has a length more than 5 km and shorter than 15 km. If an EIA is required by Turkish EA regulation or MoEF, The Environment Estate and Expropriation Directorate of TEIAS decides and coordinates the requirement for the preparation of a Category A Environmental Impact Assessment (EIA) Report and/or a Category B Environmental Management Plan (EMP) in accordance with the World Bank documentation requirements for an EIA or an EMP 1. Annex B1 contains a sample format for EMPs the format is revised and expanded based on site-specific characteristics. For the EIA studies of transmission line projects are conducted by the Environment Estate and Expropriation Directorate of TEIAS, having EIA Competency Certificate obtained by MoEF, within the TEIAS General Directorate. 1 ECSEE APL6 is categorized as environment category B, because a category A subproject is not expected to be financed by the loan. In the case that a category A subproject is required to be financed, the loan agreement for APL6 will need to be restructured. 3

For the projects under this classification generally preparation of an EMP is required based on the criteria provided in Annex A to this document. For the Energy Transmission Line Projects having length of less 4

5 than 5 km and for the projects that are classified in Annex 2 of the Turkish EIA Regulation and decided by the MoEF that a full EIA is not needed, the Environment Estate and Expropriation Directorate of TEIAS will prepare an EMP. If the Environment Estate and Expropriation Directorate of TEIAS decides that the project is small and/or with negligible environmental issues and that therefore no EMP is required, no further environmental procedures are necessary. The Environment Estate and Expropriation Directorate of TEIAS will provide written documentation of this decision together with the reasons for it EA Documentation/Document Content For the projects that require the preparation of a full EIA report (Category A projects according to World Bank classification), the reports will be prepared in accordance with the project specific format to be provided by the MoEF. However, this format will have some differences with the general format of the World Bank. The World Bank Category A EA format includes the following chapters: Executive Summary: Concisely discusses significant findings and recommended actions. Policy, Legal and Administrative Framework: Discusses the policy, legal, and administrative framework within which the EA is carried out. Explains the environmental requirements of any cofinanciers. Identifies relevant international environmental agreements to which the country is a party. Project Description: Concisely describes the proposed project and its geographic, ecological, social, and temporal context, including any offsite investments that may be required. Normally includes a map showing the project site and the project s area of influence. Baseline Data: Assesses the dimensions of the study area and describes relevant physical, biological, and socioeconomic conditions, including any changes anticipated before the project commences. Data should be relevant to decisions about project location, design, operation, or mitigatory measures. Environmental Impacts: Predicts and assesses the project s likely positive and negative impacts, in quantitative terms to the extent possible. Identifies 5

6 mitigation measures and any residual negative impacts that cannot be mitigated. Explores opportunities for environmental enhancement. Identifies and estimates the extent and quality of available data, key data gaps, and uncertainties associated with predictions, and specifies topics that do not require further attention. Analysis of Alternatives: Systematically compares feasible alternatives to the proposed project site, technology, design, and operation including the without project situation in terms of their potential environmental impacts; the feasibility of mitigating these impacts; their capital and recurrent costs; their suitability under local conditions; and their institutional, training, and monitoring requirements. Environmental Management Plan (EMP): Covers mitigation measures, monitoring, and institutional arrangements. Appendixes (List of EA Report Preparers. References. Records of Public Consultation: Record of interagency and consultation meetings, including consultations for obtaining the informed views of the affected people and local nongovernmental organizations (NGOs)) While most of these headings are covered in the specific format provided by the MoEF for the full EIA reports, there are no Executive Summary or Policy, Legal and Administrative Framework chapters. In addition, mitigation actions are required to be specified for the adverse impacts and a monitoring plan is required as a part of the EIA report by the MoEF. However, they may not be in the form of an EMP as required by the World Bank. Furthermore, institutional arrangements for the mitigation and monitoring actions are not explicitly specified as required by the World Bank. Following chapters are included in a typical Turkish EIA format for a power transmission line: Project Purpose and Description Characteristics of the Project Area Economic and Social Dimensions of the Project Influence area of the Project and Existing Environmental Properties Environmental Impacts of the Project and Mitigation Measures Analysis of Alternatives 6

7 Conclusions Therefore, for a project that requires a full EIA report according to Turkish EIA Regulation (Annex 1 projects or Annex 2 of the Turkish EIA Regulation that the MoEF decided that a full EIA is needed) the Environment Estate and Expropriation Directorate of TEIAS will decide if Category A EIA or Category B EMP will be required. If it is decided that a Category A EIA is needed, the EIA will include appendices for: (a) the Policy, Legal and Administrative Framework in Turkey, (b) the Executive Summary, (c) the EMP (including mitigation and monitoring activities as a plan) (d) the institutional arrangements to carry out the mitigation and monitoring measures and (e) the Record of Public Consultation. If the Environment Estate and Expropriation Directorate of TEIAS decides a Category B EMP will be required it will be prepared in accordance with the sample format provided in Annex B1 (Sample Format for an Environmental Management Plan) of this document. The format will be revised and expanded based on site-specific characteristics. If it is decided that the project is neither Category A nor Category B, no EA Documentation is required. For the projects that are classified in Annex 2 of the Turkish EIA Regulation and decided by the MoEF that a full EIA is not needed or for the transmission line projects having a length of less than 5 km, the Environment Estate and Expropriation Directorate of TEIAS will decide the scope of the Category B EMP according to the criteria given in Annex A to this document. The Category B EMP will be prepared by TEIAS in accordance with the format provided in Annex B1 to this document (Sample Format for an EMP) of this document. As can be seen from this Annex the key elements of the EMP are the Mitigation and Monitoring Plan (which are based on a site-specific assessment) for which samples are provided in Annex B2. Other key components of an EMP are Institutional Arrangements and Consultation with Local NGOs and Project-Affected Groups Consultation For the projects requiring full EIAs, the public consultation process of Turkish EIA Regulation is basically compatible with the World Bank. According to this regulation public information and consultation meeting is held in the scoping stage of the EIA 7

8 process. The issues identified in this meeting are taken into account in the formation of the specific format for the project and preparation of the EIA report. For Category A projects, World Bank requires, a second public consultation be conducted to discuss the draft EIA document. Public consultation for discussion is also a part of the Turkish review process of the draft EIA report: when the review period is started by the MoEF it is announced to the public and the EIA report is opened to public review at the local governorates. The locally affect groups are informed via the written announcements in the local authorities (municipalities, governorates etc.). The purpose of public consultation at this stage is to determine whether people have any remaining concerns or questions about the way that the previously identified issues have been analyzed or with the proposed mitigation measures. By these means the voice of the locally affected groups are fully recognized in the final EIA report, which is considered as the second public consultation For the consultation meetings, announcements are made by publishing an announcement including the date, hour, place and subject of the meeting in a national countrywide newspaper and in a local newspaper 10 days before the meeting date. Generally, places suitable for the participation of everybody are selected, such as a village coffeehouse. In addition, if it is found necessary arrangements for the transportation of locally affect groups to the meeting place are made. The responsibility of the public consultation issues (announcements, transportation etc.) is on TEIAS unless a consultant is hired by TEIAS for the issues. For Annex I projects, the responsible party for making the minutes of meeting, taking the attendance sheets is the local directorate of MoEF, and a copy is provided to the project owner. For a project that does not require a full EIA, but decided by TEIAS that it requires an EMP, public consultation will be announced, organized, conducted and documented as described in Annex B1 (Section E - Consultation with Local NGOs and Project- Affected Groups) to this document. The purpose of the consultation is to obtain their views on the environmental issues related to the project, which they feel are important, and whether people are satisfied with the proposed mitigation/monitoring measures. These issues will then be included in the final EMP. 8

9 For the projects which are not within the scope of Turkish EIA Regulation but EMP preparation decision are taken for by TEIAS, the public consultation meeting is announced in a national and/or local newspaper and/or via the related village headmen. The minutes of meeting and attendance records are made by TEIAS/or the consultant if one is hired, and the records are integrated into the EMP EA Review and Approval For the projects requiring a full Category A EIA, the review and approval is the responsibility of the MoEF and the World Bank. When the EIA report is completed in accordance with the project specific format provided by the MoEF in the end of the scoping phase, it is submitted to the MoEF. The MoEF first reviews the report according to the format and then calls the review committee to meetings, called as review committee meetings. In these meetings the report is presented and the questions or concerns of the Review Committee are answered and necessary changes, additions to, or removals from the report are done. The committee members review the statement according to their scope of responsibilities. Representative organizations on the Committee may include: Related General Directorates of the MoEF The General Directorate of State Hydraulic Works (DSI) General Directorate of State Meteorological Works (DMI) The General Directorate of Forestry Provincial Directorate of Environment and Forestry The Ministry of Agriculture and Rural Affairs The Ministry of Health. Provincial Health Directorate Municipalities Experts from University (if found necessary) Project owner (TEIAS) EIA Consultant As a result all Committee Members provide their opinion regarding to approval of the EIA report and the project. Before MoEF gives (final) EIA decision, following the 9

10 Committee opinion on EIA Report, the report is opened for the public review in order to take their comments at this stage. The positive decision means project is approved (generally with conditions at least indicating that the EIA report is a commitment for the project implementation and has to be complied with by the project owner and all relevant contractors of the project) and the activities should be commenced in 7 years (if they are not commenced in 7 years a new EIA report is required for the project). The negative decision indicates that project is rejected and cannot be carried out. For Category A projects, the final officially approved Turkish EIA report (for the projects that requires EIA Report according to Turkish EIA Regulation) will be translated into English by World Bank if it is required and English language versions of the World Bank appendices, or for Category B projects, and the final EMPs will be sent to World Bank by TEIAS in order to be approved. Prior to proceeding with awarding a contract for the project the World Bank will issue a No Objection for Category A projects, if the World Bank estimates that the No Objection will take longer than two weeks to issue, it will inform TEIAS as to when it will complete the review process. For Category B projects, the EMP is prepared by the Environment Estate and Expropriation Directorate of TEIAS. TEIAS experts will prepare the EMP in accordance with the requirements specified in Annex B1 of this framework document. The English version of the final EMP for any project will be submitted to the World Bank by TEIAS and will be reviewed and approved by the World Bank. The Bank s comments, and/or the No objection of the submitted EMP will be sent to TEIAS within 2 weeks. If the Bank needs more time to complete its review, it will inform TEIAS within this timeframe. The MoEF will not be a part of review or approval process for Category B projects Disclosure For Category-A projects, the approved EIA report and the World Bank appendices will be disclosed by the MoEF. These documents will be available in the offices of local authorities and are publicized on the website of the MoEF. The English version of the EIA report approved by Turkish government and the English language versions 10

11 of the World Bank appendices will be sent to the World Bank for disclosure in the World Bank Infoshop. For Category B projects which only require an EMP, the final Turkish Language EMP will be open to public access in the local TEIAS offices, where it will be convenient to the people living in or near the area where the project is to be implemented. TEIAS will make it available in its website on the internet as well. The English language version will be sent to the Bank for disclosures in the World Bank Infoshop Implementation Conditions/Obligations As mentioned before, for both Category A and Category B projects the EMP is a commitment by TEIAS to the World Bank regarding its legal obligation under the Loan Agreement to implement EMP throughout the life of the project. This commitment is the responsibility of TEIAS. Thus, prior to contract awarded by the Environment Estate and Expropriation Directorate of TEIAS will insure that all bid documents contain conditions (or articles) specifying that the approved EMP are a part of the conditions to be complied with and must be included in all bid documents and contracts. The monitoring of the performance of the contractor during construction will be carried out by the responsible parties specified in the monitoring plan. Environment Estate and Expropriation Directorate of TEIAS will be the authority to make the final check with regard to the performance of the Contractor with regard to the relevant specifications in the bid documents and EMP. For the case of an EIA report, TEIAS will have first line responsibility for assurance compliance with conditions of the EMP. However, the MoEF is the ultimate responsible agency for auditing and ensuring that the conditions in the Turkish EIA report are complied with. 11

12 2.7. Environmental Standards/Guidelines TEIAS will use Turkish or World Bank environmental standards (which ever is stricter) for electric power transmission line projects. These standards are basically related, but not limited, to the following: Environmental impact assessment Solid and hazardous waste management Noise levels (during construction) Electric and magnetic field intensities at ground level (transmission/distribution) or at the fence line (transformer substation) Polychlorinated biphenyls (PCBs) are to be prohibited from use in any equipment purchases (e.g. transformers, capacitors) or any replacement components Right-of-way selection Environmental auditing Health and safety Pesticide use for land clearance Cultural Heritage Natural Habitats The criteria and standards for the above mentioned issues, and any other relevant issue can be found in the Turkish Regulations, the Pollution Prevention and Abatement Handbook (PPAH) of the World Bank and International Finance Corporation (IFC) Environmental Health and Safety Guidelines (EHSG). With regard to these issues the requirements of Turkish Regulations will be certainly complied with. If there are no standards or requirements in Turkish Regulations or if the standards of the World Bank are stricter these will be used in construction and operation. The major World Bank documents related to these issues are Bank Safeguard Policies, EA Sourcebook and Updates, and the above mentioned PPAH and EHSG, which are available from the website of the World Bank. Some of the directly related Turkish Regulations are: 12

13 Environmental Noise Assessment and Control Regulation ( ) Water Pollution Control Regulation ( ) Solid Waste Control Regulation ( ) Soil Pollution Control Regulation ( ) Environmental Impact Assessment Regulation ( ) Environmental Auditing Regulation ( ) Hazardous Waste Control Regulation ( ) Workers Health and Safety Regulation ( ) Electric Intensive Current Regulation ( ) 2.8. Licensing and Permitting The necessary licenses and/or permits will be obtained by TEIAS itself or via its contractors for various services, such as environmental impact assessment, equipment procurement, construction etc., from the MoEF or other governmental agencies as required. Some of the permits that will be required are: Cultural assets Wetlands EIA positive or EIA not necessary certificates Permit for wastewater discharge to receiving bodies (if there is such a discharge from the construction camp facilities) Hazardous waste disposal permit for Hazardous Waste Storage, or Intermediate Storage (if applicable) Solid waste disposal permit (disposal of the solid wastes to the landfill site of the municipality due to solid waste generation in the camp facilities and during construction and operation activities) Permit to pass through a forest area (if applicable-except forestry lands to be protected) It should also be noted that in case of an undersea cable project, implementation and operation will be carried out in accordance with the Turkish Maritime laws and regulations in addition to the above listed environmental licenses and permits. 13

14 3. Implementation Phase 3.1. Institutional Arrangements for Environmental Management During construction, the Environment Estate and Expropriation Directorate of TEIAS, in cooperation with the regional offices, will check the performance of the contractor to assure the works reflects the requirements specified in the EMPs. With this regard quarterly reports will be required from the construction contractors and on-site checks will be carried out if found necessary. During operation, the Environment Estate and Expropriation Directorate of TEIAS, will assist the operations department and review their performance with regard to the obligations specified in the EMP for the operation phase of the projects. The representatives of the Environment Estate and Expropriation Directorate of TEIAS will review the environmental management performance of the regional offices of TEIAS with respect to the projects of concern Reporting TEIAS will submit the prepared (Environmental Management Plan) Monitoring Reports for the projects in Annex.2 list of Turkish EIA Regulation, for the project exempt from the Turkish EIA Regulation and for the projects in Annex.1 of Turkish EIA Regulation to the World Bank to be reviewed in a quarterly basis. 14

15 ANNEX A ENVIRONMENTAL SCREENING CRITERIA FOR DECIDING THE PREPARATION OF AN ENVIRONMENTAL MANAGEMENT PLAN If any of the following potential issues are assessed to be significant by the Environmental Unit of TEIAS, an EMP will be required for the project of concern: Change in land use or land surface contours (altering runoff patterns) Possible presence of polychlorinated biphenyls (PCBs) in equipment (transformers or capacitators) to be rehabilitated or decommissioned Soil erosion (land clearing) Possible impact to public health Removal of considerable number of trees Public exposure to electric or magnetic fields Interference with local aesthetic characteristics Permanent loss of productive land from support structure placement Environmental sensitive areas involved (protected area, sensitive ecosystems, etc.) Culturally sensitive areas involved (structures/locations of historical or archeological significance)

16 ANNEX B1: SAMPLE FORMAT FOR AN ENVIRONMENTAL MANAGEMENT PLAN (EMP) Responsible Party The name of the TEIAS staff member who prepared the EMP should be specified, his title and the date when it was prepared. Project Description Present a brief description of the subproject. Include the nature of the investment, the location, and any characteristics of the specific project site and area that are listed in Annex A, e.g. near a protected area, area of environmental, cultural, historical, religious interest etc. Also, very briefly describe the general land use characteristics (farming, small industry etc.), and the location(s) of the nearest population centers. If available, a simple map should be included. A. 27 a) Tehlikeli ve Özel İşleme Tabi Atıkların geri kazanılması ve/veya nihai bertarafını yapacak tesisler, b) Yakma kapasitesi 1000 kg/gün ve üzerinde olan tıbbi atıklar için projelendirilen yakma tesisleri, c) Günlük 1 ton ve üzeri depolama kapasitesine sahip olan tıbbi atık düzenli depolama tesisleri, ç) Yıllık işleme kapasitesi 2000 ton ve üzeri olan atık yağ geri kazanımı için projelendirilen tesisler, d) Tehlikeli atık ihtiva eden atık barajları, atık havuzları. 12- Günlük kapasitesi 100 ton ve üzeri katı atıkların yakma, kompost ve diğer tekniklerle ara işleme tabi tutulması ve bertaraf edilmesi için kurulan tesisler ve/veya alanı 10 hektardan büyük veya hedef yılı da dahil depolanacak katı atık miktarının günlük 100 ton ve üzeri olan katı atık depolama tesisleri, atık barajları, atık havuzları milyon m3/yıl ve üzeri yeraltı suyu çıkarma veya suyu yeraltında depolama projeleri. 14- Boru ile içme suyu taşımaları dışında kalan büyük su aktarma projeleri: a) Olası su sıkıntısını önlemek amacı ile akarsu havzaları arasında, 100 milyon m3/yıl ve üzeri su aktarma projeleri, b) (a) bendi dışında uzun dönemli yıllık ortalama akışı 2 milyar m3 ü aşan bir akarsu havzasından söz konusu akışın % 5 i ve üzeri miktarda su aktarma projeleri. 15- Su depolama tesisleri (Göl hacmi 10 milyon m3 ve üzeri olan baraj ve göletler.). 16- Kurulu gücü 25 MW ve üzeri olan nehir tipi santraller. 17- Kapasitesi eşdeğer kişi ve/veya m3/gün üzeri kapasiteli atık su arıtma tesisleri. 18- Et Ürünleri Üretim Tesisleri (Kesimin ve et ürünleri üretiminin birlikte yapıldığı tesisler): a) Büyükbaş hayvan kesimi ve et ürünlerinin üretildiği tesisler (500 adet/gün ve üzeri), b) Küçükbaş hayvan kesimi ve et ürünlerinin üretildiği tesisler (1500 adet/gün ve üzeri),
