The tender document shall be provided together with a list of contents. The tenderer shall check the conformity of all the documents with their respective originals and their completeness. After this inspection, two copies of a memorandum which indicates that the tenderer has received all of the documents in line with the originals are signed. One copy of the signed memorandum is handed over to the tenderer. 4.3. Doküman satış bedelinin önceden İdare hesabına havale edilmesi kaydıyla, ihale dokümanı posta veya kargo yoluyla satın alınabilir. On condition that the document sale price shall be transferred to Administration account in advance, bidding documents can be purchased via mail or courier. The request letter for the acquisition of the document via post or courier, the administration shall be notified by fax or mail at least five days prior to the date of tender with the receipt of bidding cost which deposited to the Administration s own account. The Administration, within two business days after the date of receipt of the request, shall send the document to address indicated by the Claimant by adding the form signed by authorized Administration person. In this case, mail or ship date of issuance of the document shall be accepted as date of purchase of the document. The Administration is not responsible in any way for non-arrival or arrive incomplete or late delivery of the document 4.4. The Turkish version of the tender documents will be valid for the settlement of disputes that may arise between the Entity and Tenderers in the interpretation and understanding of the tender document, in case the tender documents have been prepared both in Turkish and other languages and sold to tenderers 4.5. Ayrıca, bu Şartnamenin ilgili hükümleri gereğince, idarenin düzenleyeceği zeyilnameler ile isteklilerin yazılı talebi üzerine idare tarafından yapılan yazılı açıklamalar, ihale dokümanının bağlayıcı bir parçasıdır. 5.2. Furthermore, addendums prepared by the Contracting Entity in accordance with the related provisions of this Specification as well as written explanations made by the Contracting Entity upon the request of the tenderer constitute binding parts of the tender document. 5.3. İstekli tarafından, ihale dokümanının içeriği dikkatli bir şekilde incelenmelidir. Teklifin verilmesine ilişkin şartların yerine getirememesinden kaynaklanan sorumluluk teklif verene aittir. İhale dokümanında öngörülen kriterlere ve şekil kurallarına uygun olmayan teklifler değerlendirmeye alınmaz. 5.3. Tenderer should carefully examine the contents of all documents mentioned above. The tenderer shall assume any responsibility arising from non-compliance of the bid with the requirements relating to its submission. Bids which do not comply with the procedures indicated and described in the tender document shall be excluded from the evaluation process. Madde 6 - Bildirim ve tebligat esasları Article 6- Notification/official communication principles 6.1. Bildirim ve tebligat, iadeli taahhütlü posta yoluyla veya imza karşılığı elden yapılır. Ancak, ihale dokümanının satın alındığına ilişkin formda ve/veya teklif mektubunda elektronik posta adresinin ve/veya faks numarasının belirtilmesi ve bu adrese veya faks numarasına yapılacak bildirimlerin kabul edileceğinin taahhüt edilmesi kaydıyla, İdare tarafından elektronik posta yoluyla veya faksla bildirim de yapılabilir. 6.1. Notification/Official communication is made by the registered and prepaid mail or by the hand against signature. However, notification can be made through electronic mail or fax provided that electronic mail address and/or fax number are specified in the document indicating procurement of tender documents and/or it is undertaken to accept the notification to be made to this address or fax number. 6.2. İadeli taahhütlü mektupla yapılan tebligatta mektubun postaya verilmesini takip eden yedinci gün, yabancı isteklilerde ise ondokuzuncu gün tebliğ tarihi sayılır. Tebligatın bu tarihten önce muhataba ulaşması halinde ise fiili tebliğ tarihi esas alınır. 6.2. In official communication made through registered and prepaid mail, 7 th day following date on which the letter has been given to the post office and 19 th day for foreign bidders are considered notification date. If the notification arrives at the addressee before above-stipulated date and then actual notification date is accepted as basis. 6.3. Elektronik posta yoluyla veya faks ile yapılan bildirimlerde, bildirim tarihi tebliğ tarihi sayılır. Bu şekilde yapılan bildirimlerin aynı gün İdare tarafından teyit edilmesi zorunludur. Aksi takdirde bildirim yapılmamış sayılır. Teyit işleminin gerçekleşmiş kabul edilmesi için tebligatın iadeli taahhütlü mektupla bildirime çıkarılmış olması yeterlidir. Elektronik posta yoluyla veya faks ile yapılan bildirimler, bildirim tarihi ve içeriğini de kapsayacak şekilde ayrıca belgelenir. 6.3. If a notification is sent via e-mail or fax, the date on which the notification is sent will be the notification date. In this case, the contracting entity must make sure that the tenderer has received the notification. Otherwise the notification will be null and void. The notification delivered via registered mail is enough for the notification to be considered as valid. The notifications sent via e-mail or fax are separately documented to include the notification date and scope. 6.4. Elektronik posta yoluyla yapılacak bildirimler, İdarenin resmi elektronik posta adresi kullanılarak yapılır. 6.4. The official e-mail address of the contracting entity will be used if a notification is sent via e-mail. 6.5. İdare tarafından ortak girişimlere yapılacak bildirim ve tebligat, yukarıdaki esaslara göre pilot/koordinatör ortağa yapılır. 6.5. The notifications to joint ventures will be sent according to the above mentioned procedure to the main / coordinator tenderer. 6.6. İstekli olabilecekler ve istekliler tarafından İdareyle yapılacak yazışmalarda elektronik posta ve faks kullanılamaz. Ancak, bu Şartnamenin 4.1.d) maddesinde ihale dokümanının posta veya kargo yoluyla satılması hususu düzenlenmiş olması şartıyla, ihale dokümanının satın alınmasına ilişkin talepler faksla yapılabilir. 6.6. Potential tenderers and tenderers can t use e-mail or fax in their correspondence with the contracting entity. If the sale of tender documents via mail or courier is allowed in the article 4.1.d) of this administrative specification, the tenderers requests of tender documents may be sent via fax. II- İHALEYE KATILMAYA İLİŞKİN HUSUSLAR II- ISSUES RELATED TO PARTICIPATION IN THE TENDER Madde 7-İhaleye katılabilmek için gereken belgeler ve yeterlik kriterleri Article 7- Documents and qualification criteria required for participating in the tender 4

7.1. İsteklilerin ihaleye katılabilmeleri için aşağıda sayılan belgeleri teklifleri kapsamında sunmaları gerekir: 7.1. Yabancı istekliler, bu şartnamenin 10 uncu maddesinin (c) ve (d) bentlerinde yer alan durumlarda olunmadığına ilişkin belgeler yerine, kendi ülkelerinin mevzuat hükümleri uyarınca kesinleşmiş sosyal güvenlik prim borcu ve vergi borcu olmadığına dair beyanname verebilirler. Foreign tenderers, may submit a written pledge that they do not have any finalized debts with respect to tax payments and social security payments under the relevant provisions of the legislation of their own country, instead of the documents evidencing that they are not in the situation mentioned in sub articles (c) and (d) of the Article 10 of this specification. 7.2. Mesleki ve teknik yeterliğe ilişkin belgeler ve bu belgelerin taşıması gereken kriterler; 7.2. Documents related to professional and technical qualification and the Criteria to be met by these documents 7.2.1- İstekliler, ihale tarihi itibariyle geçerli olan aşağıda belirtilen mesleki ve teknik yeterlik belgelerini teklifi ile birlikte vereceklerdir. Bu belgeler yeterlik değerlendirmesinde kullanılacaktır. 7.2.1. Tenderers shall submit the below mentioned professional and technical qualification documents, which are still valid at the date of tender, together with their offers. These documents shall be used for qualification evaluation. 7.2.2- Üretim, İmalat Kapasitesi Belgeleri 7.2.2. Documents Relating to Production, Production Capacity a) İstekli imalatçı ise imalatçılık belgesi veya belgeleri, a) Should the tenderer is a manufacturer, they must present the manufacturing certificate(s). b) İstekli yetkili satıcı veya yetkili temsilci ise, yetkili satıcı ya da yetkili temsilci olduğunu gösteren belge veya belgeleri. b) Should the tenderer is an authorized dealer or agent, the certificate(s) proving that they are what they suggest. c) İstekli, Türkiye de serbest bölgelerde faaliyet gösteriyor ise yukarıdaki belgelerin biriyle birlikte sunduğu serbest bölge faaliyet belgesi. c) Should the tenderer runs the business in the free zone, they must present their free zone certificate of activity besides the above mentioned certificates(s). Aday veya istekliler, imalatçı olduğunu yukarıdaki belgelerden birini sunarak tevsik edebilecektir. The document(s) demonstrating that the tenderer is a manufacturer; I) Industry Registration Document issued in the name of the tenderer, II) Capacity Report issued in the name of the tenderer by the business chamber which the tenderer is a member of. III) Manufacture Adequacy Document issued in the name of the tenderer by the business chamber which the tenderer is a member of. IV) Domestic Goods Document pertaining to the offered material, which issued in the name of the tenderer by the business chamber which the tenderer is a member of. V) The documents issued by authorized institutions in the scope of the scope of the related legislation demonstrating that the tenderer is a manufacturer or producer. The tenderers can prove that that they are manufacturers by submitting one of the documents above. 7.2.3. Kalite yönetim sistem belgesinin Türk Akreditasyon Kurumu tarafından akredite edilen belgelendirme kuruluşları veya Uluslararası Akreditasyon Forumu Karşılıklı Tanınma Antlaşmasında yer alan ulusal akreditasyon kurumlarınca akredite edilmiş belgelendirme kuruluşları tarafından düzenlenmesi zorunludur. Bu belgelendirme kuruluşlarının, Uluslararası Akreditasyon Forumu Karşılıklı Tanınma Antlaşmasında yer alan ulusal akreditasyon kurumlarınca akredite edilmiş belgelendirme kuruluşu olduklarının ve bu kuruluşlarca düzenlenen belgelerin geçerliliğini sürdürdüğünün, Türk Akreditasyon Kurumundan alınacak bir yazı ile teyit edilmesi gerekir. Bu belgenin ihale tarihinde geçerli olması yeterlidir. İş ortaklıklarında, ortaklardan birinin istenilen belgeyi sunması yeterlidir. 7.2.3. The quality management system document must be issued by the institutions accredited by Turkish Accreditation Institution or institutions accredited by national accreditation institutions which are described in the International Accreditation Forum Mutual Recognition Agreement. It has to be confirmed that the institution which issued the document is accredited by national accreditation institutions which are described in the International Accreditation Forum Mutual Recognition Agreement and the documents issued by this institution are valid by a letter taken from Turkish Accreditation Institution. Confirmation letters issued on the tender date or a year before the tender date is acceptable. But it is not needed to get a confirmation letter from Turkish Accreditation Institution for the documents which are issued by the institutions that Turkish Accreditation Institution has already announced to accreditate or which have TÜRKAK Accreditation Mark. It is sufficient that this document is valid on the tender date. It is sufficient that one partner submit the required document in joint ventures. 6

7.2.4- Uluslar Arası Kurallara Uygun Şekilde Akredite Edilmiş Kalite Kontrol Kuruluşları Tarafından Verilen Sertifikalar 7.2.4. Certificates given by Quality Control Institutions accredited according to international rules. İsteklilerin dizel motor ve/veya dizel motor üzerindeki aksamların imalatına ait sahip olduğu güncel ve geçerli AAR veya IRIS veya ISO 9001 Kalite Güvence Belgesi. The manufacturers of the offered materials shall have the updated and effective Association of American Railroads Quality Assurance Program Certification AAR related to manufacturing of diesel motor and/or the components of a diesel motor or IRIS or ISO 9001 Quality Assurance Certificate. İstekli yetkili satıcı veya yetkili temsilcisi ise, imalatçının sahip olduğu yukarıda belirtilen kalite belgelerinden birini verecektir. If the tenderer is an authorized dealer or authorized representative, it shall submit one of the above mentioned quality certificate owned by the manufacturer. AAR ve IRIS belgesi için TÜRKAK tarafından teyit yazısı verilmediğinden akreditasyon şartı aranmayacaktır. As a written confirmation certificate is not presented by TÜRKAK for AAR or IRIS accreditation necessity shall not be requested. 7.3. Belgelerin sunuluş şekli 7.3. Form of submission of documents 7.3.1-İstekliler, yukarıda sayılan belgelerin aslını veya aslına uygunluğu noterce onaylanmış örneklerini vermek zorundadır. İhale konusu iş veya benzer işlere ilişkin iş deneyim belgelerinin istenilmesi halinde, iş deneyim belgelerinin noter onaylı olanlarının asılları, ihale üzerinde kalan istekli tarafından ihale yetkilisinin onayından önce idareye ibraz edilecektir. It is obligatory for tenderers to submit the originals of the above-mentioned documents or their notary public attested copies. The attestation process means the confirmation of the truth of the signature on the document, in which capacity the person who signed the document signed it and whether the seal or stamp, if any, on it is the same as original. 7.3.4.2. Official documents prepared in countries party to the Agreement on the Relief of the Attestation Obligation of Foreign Official Documents and which are covered under the 1st article of that Agreement are exempt from attestation from the Consulates of the Republic of Turkey or the Republic of Turkey Foreign Affairs Ministry, provided they bear an apostille annotation of ratification. 7.3.4.3. 7.3.4.3. In the event of existence of any agreement or covenant between the Republic of Turkey and the other state or states containing provisions which regulate the attestation process of signatures, seals or stamps on documents, the attestation of documents prepared in such countries may be made according to the provisions of that agreement or covenant. 7.3.4.4. The signature, seal or stamp on any document prepared in foreign countries which does not bear the apostille annotation of ratification or not submitted under any agreement or covenant containing special provisions relating to the attestation process, needs to be attested by the Consulate of the Republic of Turkey in the country where the document was prepared or, in the given order, by the representation, in Turkey, of the country in which the document was prepared and the Republic of Turkey Foreign Affairs Ministry. Documents prepared in countries where there is not Consulates of the Republic of Turkey should be attested, in the given order, by the Ministry of Foreign Affairs of the country in which it was prepared, the Consulate of the Republic of Turkey responsible for relations with that country or the representation of that country in Turkey and the Republic of Turkey Foreign Affairs Ministry. 7.3.4.5. Yabancı ülkenin Türkiye deki temsilciliği tarafından düzenlenen belgeler, Türkiye Cumhuriyeti Dışişleri Bakanlığı tarafından tasdik edilmelidir. 7.3.4.5. 7.3.5.1.1. It is requisite that translations of documents, prepared in foreign language, which are submitted by local applicants and business partnerships and consortiums having as partners Turkish citizen real persons and/or legal persons founded under the laws of the Republic of Turkey, are made in sworn translators in Turkey and attested by a notary. Such translations are exempt from the attestation process by the Republic of Turkey Foreign Affairs Ministry. 7.3.5.2.Yabancı istekliler tarafından sunulan ve yabancı dilde düzenlenen belgelerin tercümeleri ve bu tercümelerin tasdik işlemi, aşağıdaki şekilde yapılır: 7.3.5.2. The translations of documents prepared in discharge language submitted by foreign applicants and the attestation process for such translations are conducted as follows: 7.3.5.2.1. Tercümelerin tasdik işleminden tercümeyi gerçekleştiren yeminli tercümanın imzası ve varsa belge üzerindeki mührün ya da damganın aslı ile aynı olduğunun teyidi işlemi anlaşılır. 7.3.5.2.1. The attestation process of the translations means the process of confirmation that the signature of the sworn translator who made the translation and the seal or stamp, if any, on the document are the same as original. 7.3.5.2.2. Belgelerin tercümelerinin, düzenlendiği ülkedeki yeminli tercüman tarafından yapılmış olması ve tercümesinde apostil tasdik şerhi taşıması halinde bu tercümelerde başkaca bir tasdik şerhi aranmaz. Yabancı dilde düzenlenen belgelerin tercümelerinin Türkiye deki yeminli tercümanlar tarafından yapılması ve noter tarafından onaylanması halinde, bu tercümelerde başkaca bir tasdik şerhi aranmaz. 7.3.5.2.5. In the event the translations of documents prepared in foreign language are made by sworn translators and attested by notaries in Turkey, no other annotation of ratification is sought on such documents. 7.3.6. Kalite ve standarda ilişkin belgelerin sunuluş şekli: 7.3.6. Manner of submitting documents pertaining to quality and standards: 7.3.6.1. Uluslararası Akreditasyon Forumu Karşılıklı Tanınma Antlaşmasında yer alan ulusal akreditasyon kurumlarınca akredite edilmiş belgelendirme kuruluşları veya Uluslararası Laboratuar Akreditasyon İşbirliği Karşılıklı Tanınma Anlaşmasında yer alan akreditasyon kurumları tarafından düzenlenen Kalite Yönetim Sistem Belgesinin, Türk Akreditasyon Kurumundan alınan teyit yazısıyla birlikte sunulması zorunludur. The document for quality management system given by the documenting agencies accredited by the national accreditation institutions included in the International Accreditation Forum Reciprocal Recognition Agreement or the documenting agencies included in the International Laboratory Accreditation Cooperation Mutual Recognition Agreement must be submitted together with a confirmation letter taken from Turkish Accreditation Institute. These documents are exempt from the attestation procedure. The translations of the documents which are issued in foreign 9

languages must be made by a sworn translator in Turkey and must be approved by notary public. These translations are also exempt from the attestation process of Turkish Ministry of Foreign Affairs. 7.3.6.2. Türk Akreditasyon Kurumu tarafından akredite edilen belgelendirme kuruluşları tarafından düzenlenen ve TÜRKAK Akreditasyon Markası taşıyan belgeler için Türk Akreditasyon Kurumundan teyit yazısı alınması zorunlu değildir. Ayrıca, bu belgelerden yurt dışında düzenlenenler de tasdik işleminden muaftır. Ancak, yabancı dilde düzenlenen belgelerin tercümelerinin Türkiye deki yeminli tercümanlar tarafından yapılması ve noter tarafından onaylanması zorunludur. It is not required to take a confirmation letter from Turkish Accreditation Institute for the documents which have TÜRKAK Accreditation Mark or which have been issued by the documenting agencies accredited by Turkish Accreditation Institute. Besides, these documents which are issued outside Turkey are exempt from the attestation procedure. However, the translations of the documents which are issued in foreign languages must be made by a sworn translator in Turkey and must be approved by notary public. These translations are exempt from the attestation process of Turkish Ministry of Foreign Affairs. It is satisfactory that this document is valid at the time of tender. 7.4. Yabancı istekli tarafından ihaleye teklif verilmesi halinde, bu Şartname ve eklerinde istenilen belgelerin, isteklinin kendi ülkesindeki mevzuat uyarınca düzenlenmiş olan dengi belgelerin sunulması gerekir. 7.4. In the event proposals are submitted for the tender by a foreign applicant, documents, prepared as equivalent to the documents required in these specifications and its attachments as per the legislation in the applicant's country. 7.5.
