1 Gemi Sicilinde De ifliklik Amendment in Turkish International Ship Register Regulations Eylül 2006 tarihinde yürürlü e giren Türk Ulus- 17 lararas Gemi Sicili Yönetmeli- i ndeki de ifliklikle gemi ve yat sahiplerine büyük kolayl k sa land. Türk Uluslararas Gemi Sicili ne (TUGS) kay t olmak isteyen gemi ya da yatlar, art k Türkiye ye gelmek zorunda kalmayacak. Deniz Ticareti Genel Müdürlü ünce, Gümrük Müsteflarl ve di er ilgili kamu kurulufllar ile koordineli olarak yürütülen çal flmalar neticesinde gemilerin TUGS a kayd için Türkiye ye gelme flart, bu düzenlemeyle ortadan kalkt. Türk Uluslararas Gemi Sicili Yönetmeli inde De ifliklik Yap lmas na Dair Yönetmelik MADDE 1 23/6/2000 tarihli ve say l Resmi Gazete de yay mlanan Türk Uluslararas Gemi Sicili Yönetmeli i nin 13. maddesinin (c) bendi afla - daki flekilde de ifltirilmifltir. "c) TUGS bayrak flahadetnamesi tanzim edilen gemiler ve yatlar n TUGS a tescilinde, bayrak flahadetnamesi tanzim edildi i günden itibaren en geç bir y l içerisinde mahalli sicile baflvurulmas halinde gemi veya yat n Türkiye ye gelmesi gerekmeksizin sicile kayd yap l r. Bu süreden daha önce bir Türk liman na gelen gemiler ve yatlar n, süreye bak lmaks z n TUGS bayrak flahadetnamesi iptal edilir." MADDE 2 Ayn Yönetmeli in Geçici 1. maddesi yürürlükten kald r lm fl, afla daki ek madde ilave edilmifltir. "EK MADDE 1 2/12/2004 tarihli ve 5266 say l Türk Uluslararas Gemi Sicili Kanunu le 491 Say l Kanun Hükmünde Kararnamede De ifliklik Yap lmas na Dair Kanunda De ifliklik Yap lmas Hakk nda Kanunun yürürlü e girdi i tarihten önce; yurt d fl ndan ithal etmifl oldu u dwt ve üzerindeki ticari amaçla kullan lan her türlü yük ve aç k deniz bal kç gemileri ile 300 groston üzerindeki yolcu ve özel maksatl, özel yap l gemilerini Milli Gemi Sicili ne tescil ettiren Türk uyruklu gerçek veya tüzel kifliler, geçmifle yönelik hiçbir mali hak sa lamamak kayd yla Türk Uluslararas Gemi Sicili ne tescil ettirebilirler." onsiderable facilities were Cprovided to the ship and yacht owners in Turkey with an amendment in the Turkish International Ship Register Regulations that came into force on September 17, Ships or yachts that would like to register with the Turkish International Ship Register (TUGS) will not have to go to Turkey anymore. The new regulation eliminates the obligation of vessels to go to Turkey for registration with TUGS as a result of efforts carried out by the Turkish General Directorate of Shipping in coordination with the Undersecretariat for Customs, and other public organizations. Regulation on Amendment to the TUGS ARTICLE 1 - The paragraph (c) of the Article 13 of the Turkish International Ship Register Regulations published in the Official Gazette number on June 23, 2000 has been amended as follows: c) The vessels and yachts, for which TUGS flag certificates are issued, shall be registered with TUGS without a requirement to come to Turkey, if they file an application with the local register within at least one year from the date of issue of the flag certificates. The TUGS flag certificates for the vessels and yachts arrived in a Turkish harbor before this period shall be cancelled regardless of the time passed. ARTICLE 2 - The Provisional Article 1 of the same Regulations has been revoked and the following supplementary clause has been added: SUPPLEMENTARY ARTICLE 1 - If the real persons or legal entities of the Turkish national that registered with the National Ship Register their cargo vessels and open sea fishing vessels of 3,000 dwt and above, as well as passenger and specially built vessels of 300 gross tons and above, which were imported for commercial use, file an application within one year before the date of entry into force of the Law on the Amendment of the Law regarding the amendment of the Turkish International Ship Register Law Number 5266, dated December 2, 2004, and of the Decree no 491, they may register these vessels with the Turkish International Ship Register provided that they do not acquire any retroactive financial rights. 076

Feramuz Aflk n hamber of Marine CEngineers (GEMIMO) concluded a reciprocal recognition agreement with the London based Institute of Marine Engineering, Science and Technology (IMAREST). Feramuz Askin, Chairman of GEMIMO, and Hakan Tuna, Vice Chairman, visited the head office of IMAREST in London between October 9 and 10, 2006, as the guests of David Cobb, Chairman of IMAREST. As a result of the meetings that lasted two days, both parties agreed upon reciprocal recognition, accreditation of the Istanbul Technical University (ITU) Maritime Faculty by IMAREST, rapid membership of GEMIMO members to IMAREST following the accreditation, and granting the Chartered Engineer and Incorporated Engineer degrees to the members of GEMIMO as well. Waste Disposal Facility for Istanbul he Turkish Ministry of TEnvironment and Forestry establishes a huge facility for disposal of the wastes from factories in the Marmara Region. The facility will be established on an area of 160,000 square meters and cost around 100 million euros. The preparations for tender will commence as of end of this year. The existing Izmit Waste and Residue Treatment, Incineration, and Recycling Co. (IZAYDAS) has a waste processing capacity of 35,000 tons, while the new facility in Istanbul will have an annual capacity of 100,000 tons. It will be obligatory for the new plants to be established in the region to dispose of their wastes in this new facility. The Ministry of Environment and Forestry will also establish similar waste disposal facilities in Ankara, Eskisehir, Izmir, Bursa, and Mersin-Tarsus as well. MARINE & COMMERCE OCTOBER

Proje bitti inde hatt n kapasitesinin günde 1.5 milyon varil petrol olaca öngörülüyor. alik Energy and its Italian Cpartner, ENI, which obtained the contract for construction of the Samsun- Ceyhan Pipeline, concluded the partnership agreement for the company established for the purpose of implementation of the project. 50% share of the company named Trans Anatolian Oil Pipeline Corporation (TAPCO), which was established by Calik Energy, was transferred to Italian ENI company with a protocol, which was also attended by the Turkish Minister of Energy Hilmi Guler. The signing ceremony was attended by Ahmet Calik, Chairman of the Board of Directors of Calik Energy, Pietro Cavvanna, General Manager for ENI Kazakhstan and Middle East, and Mithat Rende, Vice Chairman of the Energy Department of the Turkish Ministry of Foreign Affairs. According to the agreement, the license granted to Calik Energy for the project will be transferred to the new company TAPCO. TAPCO will be responsible for the design, construction and operation of the transportation system that will transfer oil from facilities located near the Samsun Port in the Black Sea to the Ceyhan Terminal. A new loading terminal will be built in Samsun, storage facilities in Ceyhan, and a pipeline of 550 km. Once the project has been completed, the line is estimated to have a daily capacity of 1.5 million barrels of oil. With the new vessel purchased at a price of 40.5 million dollars, the company increased its carrying capacity to 291,966 dwt, and increased its share in Turkey s total 4 million tons of carrying capacity by 8%. The Supramax vessel taken delivery of on September 12, 2006 at the Port of Hong Kong is said to be the one and only in Turkey. 078
