On the occasion of 2010 having been declared as Japan year in Turkey, Consul General of Japan in Istanbul, Katsuyoshi Hayashi calls our attention to the friendly relationships and similarities between Japan and Turkey and shares his views concerning Japanese and Turkish investors with our readers in the Road Map section of this issue. In the Magnifier section, where we regularly cover YASED s activities, you can read about the Award Ceremony of the Academic Research Competition organized by YASED, and which has now become a traditional occasion. Another report that appears on this section is about the second Member Meeting of the year, held with the objective to inform members in detail about the activities carried out in the previous term and exchange views with them on the working agenda of the coming term. The Working Groups section focuses in this issue on the activities, structure and agenda items of the Taxes and Incentives Working Group chaired by YASED Vice-Chairman Adnan Nas. Nas in this context, shares his opinions with us on the consequence of taxes and incentives in the country s economy, the significance of working groups and the plans of his Working Group for the coming terms. Ülkemiz ekonomisi, küresel çapta yaflanan olumsuz ekonomik geliflmelerin etkisinde kald. ç piyasada ve d fl pazarlarda azalan talebin yol açt durgunluk, yat r m ortam n olumsuz yönde etkiledi ve iflsizlik oran n n ciddi flekilde yükselmesine sebep oldu. Durgunlukla birlikte azalan vergi gelirleri, kamu aç n n bir önceki y la göre devasa oranda artmas na yol açt. Küresel krizin bafllang c na kadar yüksek büyüme performans yakalayan Türkiye ekonomisi, 2009 y l nda küçüldü. Bozulan ekonomik dengeler, tüketicilerde ve ifl dünyas ndaki güven kayb ve artan belirsizlikler, yat r m ortam n da olumsuz yönde etkiledi. Küresel mali kriz ve ekonomik daralma, geliflmekte olan ekonomilere akan finansman kaynaklar n da azaltt. Turkey, although having accomplished to increase its FDI inflows to a large extent in recent years, could attract only approximately USD 8 billion FDI in You will remember that the inward FDI flows to Turkey had realized around USD 18 billion in The 56% drop in FDI inflows to our country in 2009 on the previous year remained well above the overall world and developing countries averages. Observations on Turkey s Economy and Investment Environment Dear Insight YASED Readers, We have left behind 2009, as a year throughout which the global financial crisis continued to affect the world economy unfavorably. Our country s economy was influenced by the adverse economic developments experienced on the global scale. The recession caused by the decreased demand both in the domestic and overseas markets, affected the investment environment adversely, and led to a significant rise in the unemployment rate. Decreases in tax revenues as a result of the recession, led to an enormous increase in the public deficit compared to Turkey s economy, which had achieved a high growth performance until the dawn of the global financial crisis, contracted in The disrupted economic equilibrium, loss of confidence in consumers and in the business world, and the rising uncertainties also negatively affected the investment environment. The global financial crisis and the economic contraction curtailed the capital inflows to developing economies as well. Last year, global FDI flows decreased by 39% compared to Global FDI flows dropped from USD 1.7 trillion in 2008 to USD 1 trillion levels in All countries were widely affected by this fall. As for the FDI inflows to developing countries, in 2009, the fall was at the level of 35% compared to the prior year. Although Turkey has managed to increase FDI inflows to a large extent in recent years, in parallel with the global developments, it was able attract approximately USD 8 billion investments in However, in 2008, the inward FDI flows to Turkey were around USD 18 billion. With an 56% annual decline, FDI inflows to Turkey in 2009 fell by a rate well above the global and developing countries averages. The competition conditions for Turkey to become a center of attraction among other developing countries and to maintaining such a position, has thus become much more challenging. Uncertainties as to whether or not the world economy will recover in 2010 remain. Despite the relative recovery observed in recent months, concerns about the financing and elimination of public deficits caused by

Dolay s yla yeni dünya düzeninde etkin bir flekilde rekabet edebilmek için, d fl sermaye ve d fl finansman ak fl n sürekli k lacak tedbirler al nmas ve sektörel stratejiler oluflturulmas gere i öne ç k yor. Türkiye nin rekabet avantajlar n do ru saptay p, mal ve hizmetleri küresel bazda rekabet edebilir maliyetlerle üretebilmesi gerekiyor. Bugünlerde akademik çevreler de iflen dünya düzeninde, küresel eksenin bat dan do uya, yani geliflmifl ülkelerden geliflmekte olan ülkelere do ru kayd n konufluyor. Genç nüfusu ve tasarruf fazlas olan geliflen ülkelerin daha h zl büyüyüp küresel talebi art rarak geliflmifl ülkelerin yol açt tüketim aç n yak n bir gelecekte kapat p kapatamayacaklar tart flmas sürüyor. Hiç flüphesiz geliflmekte olan ülkeler küresel do rudan d fl yat r m pastas ndaki paylar n ciddi oranda art racaklar, gerek s f rdan yat r mlar gerekse sat n almalar artacak. ç talebini art rabilen ve ekonomik ve siyasi istikrar n koruyabilen ülkeler bu yeni d fl yat r m ak mlar n da çekecek. Türkiye, büyük ve genç bir nüfusa sahip olmas na karfl n, iç tasarruf aç yla di er geliflen ülkelerden ayr fl yor. Tüm bu geliflmeleri bir arada de erlendirdi imizde, Türkiye nin dünya ekonomisindeki rekabet gücünü art racak politikalara, hangi alanlarda uzmanlafl p rekabet avantaj elde edece ine dair bir stratejiye, yeni dünya düzeninde lokomotif olmas beklenen geliflen ülkeler aras nda yer almas n sa layacak uzun vadeli bir vizyona ve kay tl tasarruflar n art r lmas na yönelik yap sal reformlara ihtiyac oldu u sonucu ortaya ç k yor. the crisis are starting to grow in many countries. According to some economists, there is still risk of a second dip in the global crisis, due to the concerns on public finance and the magnitude of the damage caused by the crisis. Under these conditions, a substantial recovery is regrettably not anticipated for the investment environment in For Turkey, which does not have adequate domestic savings and is reliant on external financing for growth, it is now more crucial than ever, to attract FDI in an environment, where capital is scarcer than before, in order to generate jobs for its young population and maintain a sustainable economic development. Therefore, it reveals that, in order to compete effectively in the new world order, appropriate measures need to be taken and sector-specific strategies need to be developed to secure continuous inflow of foreign capital and external financing. Turkey should properly determine its competitive advantages and produce goods and services at globally competitive costs. Academic circles nowadays assert that the centre of gravity in the world economy is shifting from west to east, from developed to developing countries, within the changing world order. The debate as to whether or not developing countries with young population and savings surpluses could grow faster, increase global demand and thus close the consumption gap caused by developed countries in the near future is still ongoing. Developing countries will undoubtedly increase their shares in the global FDI pie significantly, and both greenfield investments and acquisitions will expand. Countries that are able to increase their domestic demand and maintain their economic and political stability will attract new FDI. Although Turkey has a large and young population, it differs from other developing countries because of its domestic savings gap. When we take into consideration all of these developments together, it becomes apparent that Turkey requires policies to strengthen its competitive power in the global economy, a strategy to determine the areas in which it would specialize and acquire competitive advantage, a long-term vision to ensure that it takes place among the developing countries that are regarded as the prospective engines of the new world order, and structural reforms aimed at increasing registered savings. When we establish our strategy and plans for future, we must properly analyze the trends in the world economy and their Gelece e yönelik strateji ve planlar m z olufltururken, dünya ekonomisindeki trendleri ve bunlar n ülkemiz üzerindeki olas etkilerini iyi analiz etmemiz gerekiyor. Türkiye nin mal ve hizmet ticaretinde büyük ölçüde Avrupa ya ba ml l bulunuyor. Ancak baz Avrupa ülkelerinde yaflanan son geliflmeler, yüksek borçluluk, düflük verimlilik, esnek olmayan para ve kur politikalar ve farkl maliye politikalar nedeniyle, Avrupa bölgesinin yak n gelecekte ciddi ekonomik zorluklarla karfl laflabilece ini gösteriyor. Buna ek olarak, yafllanan nüfusu nedeniyle, en büyük ihracat pazar m z olan Avrupa n n d fl mallara olan talebi önemli ölçüde azalabilir. Öte yandan, h zla geliflen Çin, Hindistan ve Asya ülkelerinin etkisiyle, gerçekten dünyan n ekonomik ekseni bat dan do uya do ru kay yor. Dolay s yla Türkiye nin mal ve hizmet ticaretinde bu ülkelerin pay n art rmaya ve Avrupa ya ba ml l n dengelemeye yönelik stratejik bir vizyona da ihtiyac var. Bu çerçevede, Türkiye nin bölgesel iliflkilerini de iflen dengeler paralelinde yeniden konumland rma çabalar büyük önem tafl yor. Büyük ölçüde imalat sanayi odakl olan mevcut teflvik sisteminin de, oluflturulacak stratejik plan çerçevesinde, rekabet gücünün yarat laca tüm sektörlere ve özellikle de turizm, sa l k ve biliflim gibi hizmet sektörlerine de odaklanmas gerekiyor. Türkiye, önceki krizlerden ald dersler ve özellikle bankac l k sisteminde hayata geçirdi i yap sal reformlar sayesinde, küresel krizin ülkemizin mali sistemi üzerindeki olumsuz etkilerini, birçok ülkeye göre daha s n rl tutmay baflard. Bu sonuç flüphesiz hepimiz aç s ndan sevindirici. Ancak bu dönemde ülkemize giren kay tl sermaye girifllerinde ve yurt d fl ndan al nan kredilerdeki düflüfl, buna mukabil tek seferlik olarak nitelendirilebilecek varl k bar fl ve net hata/noksan kaynakl girifllerdeki art fl, fleffafl n art r lmas ve kay tl sermaye girifllerinin özendirilmesine yönelik yap sal reformlara öncelik verilmesi gere ine iflaret ediyor. Öte yandan reel sektörde krizin etkileri daha a r hissedildi. Bu durum, reel sektörün de yeni dünya düzeninde rekabet avantaj yaratabilmeyi sa layacak yap sal reformlar hayata geçirmesinin önemini ortaya koyuyor. Yat r m ortam n daha da iyilefltirecek düzenlemelerin, bu reformlara paralel olarak h z kesmeden devam etmesi, Türkiye ekonomisinin yeniden yüksek büyüme trendini yakalamas için büyük önem tafl yor. Ülkemizde do rudan yat r mlar n teflvik edilmesi amac yla potential impact on our country. Turkey is greatly dependent on Europe, for trading its goods and services. However, recent developments in some European countries indicate that the European zone might face considerable economic challenges in the near future, due to high indebtedness, low productivity, inflexible monetary and foreign exchange policies and diverse fiscal policies. Furthermore, the demand for import goods by Europe - our No. 1 export market - might weaken considerably, because of its aging population. On the other hand, the world s economic axis is indeed shifting from west to east, due to the rapidly developing China, India and other Asian countries. Turkey therefore needs a strategic vision that would focus on increasing the share of these countries in Turkey s goods and services trade, and counter-balance the country s dependence on Europe. In this context, Turkey s efforts to re-align its regional relationships in parallel with the changing balances, is of great significance. Our existing incentive system, which is focused essentially on the manufacturing industry, should also concentrate on all sectors, in which, competitive advantage will be created within the scope of the strategic plan to be developed, and particularly on service sectors such as tourism, health-care and information and communication technologies. Thanks to the lessons it had learned from previous crises and particularly due the structural reforms it had implemented in the banking system, Turkey succeeded in restraining the adverse impacts of the crisis on the country s financial system, much better than many countries could. This accomplishment is certainly quite pleasing for us all. However, the drops in registered capital inflows to our country and in the loans provided from abroad during this period on one side, and the increase in inflows originating from cash repatriation and net errors/omissions, which can be regarded as non-recurring revenues on the other, indicate the necessity to give priority to the reforms for increasing transparency and to promote registered capital inflows. On the other hand, the effects of the crisis have been felt more deeply by the real sector. This demonstrates the importance of the real sector to implement the structural reforms aimed at generating competitive advantages in the new world order. The continuity of the legislative and regulatory changes without losing momentum, which aims to further improve the investment environment in line with these reforms, is extremely important for Turkey s economy to achieve a high-growth trend once again.

In order to promote FDI inflows to Turkey, significant progress has been achieved to date. Simplicity and improvements have been achieved in many areas, thanks to the platforms such as the Coordination Council for the Improvement of the Investment Environment; and important steps have been taken to resolve investors problems. However, while so vital changes are taking place in the world economy, we regrettably are witnessing some developments in our country, which increasingly impair the investment environment. Rising concerns about the rule of law, uncertainties in the legal framework and particularly in the taxation implementations, the conflict atmosphere and tensions between institutions with the potential to damage the country s political stability, lead to significantly negative impacts, in terms of Turkey s prospects to attract new FDI and retain the existing investments. In the business world and among foreign investors, there has been an increasing perception that political problems are starting to override economic priorities. Our country urgently needs to solve the existing problems relating to its investment environment and to increase predictability. In practical terms, further development of public-private sector cooperation, improvement of dialogue and coordination between institutions, elimination of the uncertainties in legislation, within the scope of Turkey s adaptation to the EU Acquis, and reinforcement of the rule of law, are the key factors for enhancing investor confidence. Turkey needs to focus on economic priorities and the strategic issues of the rapidly changing world, in order to achieve a sustainable growth performance and generate employment opportunities for its young population. Our common aim should be; to build our country as an internationally acknowledged education, production and service base, which is preferred over our competitors. In line with this objective; the issues such as the prevention of the unregistered economy, protection of intellectual property rights, and attraction of high value added investments focusing on the development of R&D capacity are among YASED s priorities. As has been the case until now, we as YASED will continue to make significant contributions to the efforts made for the improvement of the investment environment and for increasing the FDI inflows to our country, and act in cooperation with the related public institutions in the future.

In the opening address of the General Assembly, YASED Chairman Piraye Antika said, The world s economy is going through hard times. The global financial crisis and economic contraction has drained the finance resources available for developing economies. It is now much more difficult for Turkey than before to step among these countries and sustain its position, because of the new competition conditions. Political and economic stability is essential for investments Antika pointed out to the significant developments experienced in Turkey regarding direct investments since 2003, and added, Even though direct investment inflows have slowed down during the last two years, owing to global trends, we know that it had climbed from an average annual figure of USD 1 billion, first to USD 10 billion and then to USD 20 billion levels during the last 10 years. Facilitations have been provided and developments have been accomplished thanks to platforms such as the Coordination Council for the Improvement of the Investment Environment significant steps have been taken with the purpose to solve investors problems. Antika also pointed out that in addition to the incentives focused on the manufacturing industry, service sectors such as tourism, healthcare, ICT that would sharpen the country s competitive advantages should also be given weight to. Antika said, Developing countries will enlarge the pieces they are taking from the global FDI cake. Both greenfield investments and acquisitions will increase in these countries. Countries which will succeed in increasing their domestic demands and maintaining their economic and political stability will attract new FDI. Transparency should improve Chairman Antika mentioned that Turkey required a vision that would facilitate it to take place among developing countries, which are regarded as the prospective engines of the new world order. Antika pointed out that although the impacts on Turkey of the crisis, which in general has caused adverse effects on the world, were confined, thanks to the structural reforms; it still manifested itself in decreases in registered capital and loan drawals. Minister Babacan mentioned that the Government wanted to eliminate the foreign notion from minds and has taken numerous measures to improve Turkey s investment environment. Babacan gave an account of the measures the Government has taken since Minister Babacan told the participants that the cumulative amount of FDI inflows to Turkey since 2003 has exceeded USD 80 billion, and that the FDI inflows in 2009 had been around USD 8 billion in spite of the global economic crisis. Babacan added; Given the fact that investments are the economic driving force of a country, the significance of this accomplishment is self evident. Following these speeches, Piraye Antika made a presentation on the 2009 activities of the Association. The Annual Report of the Board and the report of the Board of Auditors were read and both Boards were acquitted. The 2010 budget was then put to debate and approved. YASED s Charter did not stipulate elections this year, and the Board in office will therefore continue to serve for one year more. It was also announced at the meeting that YASED Board would hold a special Economic Coordination Council (EEC) meeting on International Direct Investments, to be chaired by Minister Ali Babacan on Monday March 1st. This EEC meeting was held on 1 March 2010 as scheduled.

Unfortunately, Japan airlines had no flight to Teheran at that time. So many Japanese, even if they had a ticket, couldn t get a seat. More than 200 Japanese, many of them women and children, were stuck in Teheran. And the deadline was coming closer. So, what shall we do... So, the Japanese Ambassador of that time consulted with the Turkish Ambassador in Teheran, and asked whether there is a possibility to fly a Turkish Airlines special flight to Teheran to evacuate 200 Japanese. We place importance on tradition. We respect older people a lot. This is a very similar value in Turkish and Japanese societies. Of course, there are different aspects, for instance, the Japanese society is an agricultural society. The Turkish society moved from one place to another for centuries. The different lifestyles influenced our ways of thinking.. You probably have caught the opportunity to familiarize yourself not only with the economic, but also with the cultural aspects of Turkey, because of your job. What does Turkey mean to you in this regard? From Turkey, I learned how to live in a diverse society. Japan is an island society. Japanese society is required to be homogenious. Surrounded by the sea, and used to be protected by the sea. Here, it is a continent, and many people come and go. Third, yes, this is also one of the similarities between Japan and Turkey, you work very hard. So do we. So, there is plenty of excellent labor force. So that is another point. That s why a growing number of Japanese businessmen and companies pay more attention to Turkey s economy. Of course, there are some drawbacks. This is my personal impression. For instance, infrastructure costs. Particularly in Istanbul, rent is very high. And of course, some taxes, consumption taxes are very high. People say that laws and regulations change very quickly here. Furthermore, customs procedures are quite complicated. And another thing, the application of laws and regulations is not regular, sometimes it depends on people. In some places, everything goes very smoothly, but in some places, it is stuck. It is very unpredictable. Unpredictability is a negative element in business. What do Japanese investors expect from the Turkish Government? The Turkish Government is doing a very good job. For instance, the agency of investment, investment infoseek, you know, they try to be a one stop shop for potential investors. That is very good. I think tax problems, they are doing their best. But as you know, many companies are suffering from getting work permits especially for engineers. But I think the people concerned are working hard to solve this issue in the very near future. I hope that they will succeed to make our lives much more easier in the near future. What are the most recent changes in the business and investment environment in Japan? How do you guide Japanese investors at the consulate? What sort of services do you offer them? We have a sort of trade office, Japanese trade office, outside the consulate. Japan External Trade Organization: JETRO. JETRO gives information on Japan to Turkish businessmen, and they provide information on Turkey s economy to Japanese businessmen. This is one thing they are doing. The second thing is, in London, Frankfurt and Dusseldorf, they are making a seminar on Turkey s economy. Because in London and Düsseldorf, there are many Japanese companies that have offices. JETRO is trying to educate Japanese businessmen living there about Turkey. Turkey is changing, Turkey is growing. They are giving the information on Turkey in European cities where a lot of Japanese live. This helps Turkey. Sometimes, they help matchmaking, you know, between Japanese companies and Turkish companies. We direct people to JETRO. Is there anything else you would like to say? Seeing is believing. I want more Japanese businessmen to come to Turkey and see the reality. And vise versa. I want more Turkish businessmen to go to Japan and to see through their own eyes. That is very important. Recently, I read in the newspaper that one Turkish company will start to produce Japanese motor cycles in one of the North African countries, to sell to African countries. This is very interesting. Japan, Turkey, North Africa, and the market is Africa. This kind of collaboration may be the future. In the construction area, Japanese contractors and Turkish contractors are cooperating, in building the airport in Kampala, I think. And also, we have a joint project in Dubai, the Dubai metro. YASED s 10th Academic Research Competition gathered quite a lot of university students in an innovative crucible. The competition involved a chain of issues such as the role of institutionalization in maintaining sustainable performance in SMEs, the impacts of institutionalization on success in privatization, its contribution to the domestic industry and SMEs for gaining access to/integrating with international markets, and its impacts on the development of the domestic industry and SMEs on areas of innovation and R&D. The subheadings of the competition covered the effects of institutionalization on the development of intellectual and industrial property rights as well as suggestions for Turkey. The winners received their awards at a ceremony held on 11 January 2010 in Istanbul. YASED s 11-member jury, after making a diligent analysis of the papers sent by under-graduate, graduate and doctorate students from all universities in Turkey, did not find any work worthy of the 1st prize. Eventually, the paper titled The Impacts of International Investment on Domestic Industry and SMEs in the light of Global Value Chains and Business Connections written by fierafettin Özsoy from Istanbul Technical University, Faculty of Chemistry and Engineering was deemed worthy of the 2nd prize, and the paper prepared by Mustafa Malkoç from Zonguldak Karaelmas University, titled The Impacts of International Investment on SMEs: The Istanbul Model received the 3rd prize. Chairman Antika from time to time gave the floor to the chairmen of various working groups during her presentation, for them to recount the activities of YASED s working groups in more detail. The economic recovery is expected to be limited Antika pointed out that the global economy still retained some risks on account of the crisis, and said; The factors that have caused the crisis are enduring. So, although signals indicating that the global crisis is drawing towards an end are perceptible, there are still risks involved. International investment inflows to Turkey are expected to undergo a limited recovery in 2010 with respect to But we predict that the level will remain lower than it was before the crisis. YASED s priorities coincide with Turkey s in this demanding economic and investment environment. We have focused mainly on one-to-one contacts with Ankara In her speech, Chairman Antika underlined the efforts exerted to keep YASED s priority issues, which were designated in line with members guidance and members contributions, on Ankara s agenda. Antika mentioned that they have worked to keep the relationships with the government and bureaucrats strong and to have YASED s views shared at top level, and have made a number of visits to Ankara as YASED Board in this connection. Antika recounted the private meeting YASED Board had with Prime Minister Recep Tayyip Erdo an and the related Ministers at YASED s last Ankara Reception, and told that the problems faced in connection with the laws and regulations and the implementations thereof were reviewed in this meeting under two

The Chairman of the Taxes and Incentives Working Group, Adnan Nas stated that the priorities of his group were the works carried on for increasing the predictability level of tax implementations. Nas recounted that their current agenda items were the code implementations (i.e. lists of negative taxpayers), tax audits, and transfer pricing, and pointed out that the details of the tax aspect of the new incentive system are still pending. The Chairman of the European Union Working Group, Tulu Gümüfltekin drew members attention to the importance of 2010 with regard to the Turkey-EU relations. Gümüfltekin pointed out that the first significant contribution of the working group, which was established only last year, has been the views established by consolidating the views of YASED s individual working groups before the Progress Report. Gümüfltekin informed the members on the contacts and the round table meetings planned for the coming term, and underlined the consequence of members further participation in working groups activities. The Chairman of the R&D Working Group, Barhan Özce stressed the unlikelihood for Turkey to accomplish the designated

The members are asking for predictability and coherence In the second part of the presentation, the results of the survey sent to the members before the Member Meeting were shared with the participants of the meeting. It was perceived that predictability and transparency, economic and political stability and unregistered economy and unfair competition have developed as the priority issues of YASED members. It was reiterated once more that working groups are the most correct platforms for evaluating these issues in a most rational manner. It was also announced that a new index study, based on the results of the Barometer Survey was given start to. It was put forth during the Q&A session held at the end of the meeting for taking members views that it was necessary to monitor energy investments in particular, and Public-Private Partnerships (PPP) would be concentrated on in this connection. Members voiced the great difficulties faced with when unpredicted amendments in the legislation have to be explained to global executives, and requested YASED to underline the significance of the coherence factor during its top level contacts.

YASED Taxes and Incentives Working Group constitutes a structure, where the participating representatives of international companies outnumber all other working groups and where the agenda items are frequently put to debate. YASED Vice-Chairman and Chairman of the Taxes and Incentives Working Group Adnan Nas states that taxes and incentives affect investment decisions considerably and adds that his Group is carrying out works aiming at making the investment environment more attractive. We asked Nas for his opinion on the place of taxes and incentives in the country s economy, the significance of the Taxes and Incentives Working Group, and the Group s plans for the coming term. Taxes and incentives are among the priority issues of YASED. Could you tell us about the fundamental reasons that make taxes and incentives significant regarding the investment environment? If you plan to make an investment in any country, you would like to know how much tax you would pay and configure your investment accordingly. Turkey has some disadvantages when compared with western countries with regard to its investment environment. We do not have a bright image and we lack investor confidence. In other words, our investment environment is not adequately attractive. This is not an unusual situation for underdeveloped countries; but Turkey is one of the leading developing economies of the world and is also one of the emerging markets; and should therefore expedite its efforts oriented towards improvement of its investment environment. Adjusting taxes is not the only way to increase the attractiveness of investments. You have to provide investors law security too. As a matter of fact, tax is a part of law order. You cannot give confidence to investors if your laws and regulation change very frequently. Besides stability deficiency, retroactive implementations of the legislation constitute additional risks for investors.

The incentive regime is a subject, which changes frequently in Turkey and which is frequently discussed whether it justifies its objective or not. YASED therefore keeps this issue always on its agenda. Unfortunately such events that damage investor confidence have been experienced in Turkey in the past. Turkey has consequently faced hardships in attracting resources from abroad for a long period of time. Why do you take up taxes and incentives as a whole? Incentives, like taxes play an important role in attracting investments to our country. Furthermore, most of the incentives are tax-related. For instance, the principal incentive element in Turkey has been tax allowance for many years. Again, the R&D Law enacted last year was in point of fact, a tax incentive. We must increase our transparency What in your opinion is Turkey short of for attracting investments? Institutionalization should become widespread all over Turkey. Institutionalization is necessary not only for the public, but the private sector too. Reporting infrastructure is inadequate. We are experiencing some difficulties in speaking the same language with foreigners. Data sets and financial sheets should be prepared according to the same standards. This weakness prevents us from doing business with foreigners. We also have to increase our transparency level on the country scale. Factors like reporting, bureaucracy and corruption decrease transparency too. Low transparency generates an effect on investors as if there is a concealed corporate tax in the country. Turkey has started increasing its transparency level thanks to some reforms made in recent years. But we have still a long way to go. On the other hand, we can channel investments to areas which open greater employment opportunities or which bring in more technology, by taking less tax from these areas. Turkey s investment environment started to enliven in 2004 after the talks made with the EU. Turkey is a country with a potential to attract USD billion direct investment annually. This figure was USD 1 billion in the past. In 2007, it climbed up to USD 22 billion. It dropped however to USD 8 billion in 2009, because of the crisis. We have to confide in ourselves that we will increase this figure after the crisis. Common wisdom, common road How does your working group take up an issue? Our Group is abundant with members. Our member portfolio represents all YASED member companies. We are one of the groups enjoying the highest participation rates, since taxes and incentives is an issue which produces significant results for companies. It directly affects their financial plans. Our members can bring up various issues to the Group s agenda either during meetings or by letters. We discuss these issues with the company

We convene our working group in order to express a view on such issues. We first draw up a draft view and present it to the Board. Our working group has therefore to meet frequently. We update our members about the amendments made in the legislation. Agenda items are not taken up only by the working group. We also inform our members about such issues with seminars. The preparations for all these activities are made in the working group. Could you describe us the profile of your working group? We have YASED member companies representatives in our working group. Members from all sectors can join our Group. Members from banking to automotive, chemistry and food are being represented in the Group. As for the Group s profile, we generally have assistant general managers, finance managers or financial directors, tax managers or the assistants of these in our Group. In special cases we may also have participations from the Board level. What sort of issues come to your working groups agenda? Transfer pricing is one of the issues on our agenda. This for instance is an issue that previously did not exist in Turkey. It was introduced in order to conform to OECD principles. The Corporate Income Tax Law has taken effect, but there are still many problems associated with its implementation. On such issues, we are sharing the information on how we can establish contact between the private sector and the Ministry of Finance and other related public establishments. Tax auditing is an extremely important issue for us, since we receive complaints from our members from time to time. We examine these complaints and notify the Ministry in case the claim is justified. For example, we brought to our agenda the fact that the code practice has deviated from its objective and has been disturbing out members from time to time. We conveyed our views on the issue to the Government and they took it into consideration and gave efforts to put the practice on a right track. YASED, in such cases makes valuable contributions. Furthermore, in case a new burden is encumbered on a sector, we again examine it. Everybody can benefit from our works. En az ndan kurumlaflm fl sektörlerde bu uygulamaya geçebiliriz. Bu tür k rtasiye ifllerini azaltmak, vergi denetimini daha etkin hale getirmek, bilgisayar ve veri taban n daha çok kullanarak denetimi daha h zl hale getirmek gerekiyor. As compared with the past, the Government displays an approach, which encourages a more open and effective dialogue with the private sector in recent years. From time to time we feel obliged to criticize some implementations. We approach them with good will and try to explain the problem. The Government is aware that YASED is an unbiased and transparent NGO and listen to what it says. They also know that Turkey necessitates foreign investments. This is something positive. They listen to our suggestions and try to implement these to the extent these conform to their own policies. Unregistered economy gives great damage to our country How do your members contribute to the working group? Our members make valuable contributions to us by taking part in the discussions. They also write to us when they have problems, with their justifications. When an issue comes to the agenda, we say, Please submit your views until such and such date. We then evaluate these incoming views all together, and establish YASED s view. We cannot tolerate mistakes, since we submit a view to the Government. We have good relationships with our members too. They confide in YASED s impartiality and image. I can therefore easily say that we have a very productive atmosphere in our meetings. Which issues will be on your agenda in the next term? We are planning to launch works for extending electronic book keeping and tax implementations. In Turkey we keep binders and binders of accounting books. All these have to be carried to electronic medium. We can at least switch to this practice in institutionalized sectors. We need to decrease such paperwork, effectuate tax audits and expedite audits by making use of computers and data bases more extensively. We can thus deter tax evaders. Unregistered economy is giving great damage to our economy. We are continuously bringing forward proposals to the Government for decreasing unregistry. We will continue to bring forward proposals on other issues as well. We are carrying out joint works with the other working groups of YASED, since all have something which involves taxes or the tax legislation.
