PCT Applicant s Guide National Phase National Chapter Page 5 THE PROCEDURE IN THE NATIONAL PHASE.01 FORM FOR ENTERING THE NATIONAL PHASE. The Office has available a special form for entering the national phase (see Annex.II). This form should preferably (but need not) be used..02 ANSLATION (CORRECTION). Errors in the translation of the international application can be corrected with reference to the text of the international application as filed (see National Phase, paragraphs 6.002 and 6.003)..03 LANGUAGE OF PROCEEDINGS. The language of proceedings is Turkish..04 FEES (MANNER OF PAYMENT). The manner of payment of the fees indicated in the Summary and in this chapter is indicated in Annex.I..05 POWER OF ATTORNEY. Where an agent is appointed, a power of attorney must be furnished. It may not be necessary to file a copy of the power of attorney unless under special circumstances. A model is given in Annex.III. TPDL Art. 54.06 FORMAL EXAMINATION. The Office carries out a formalities examination. If the result of the examination shows that the application contains formal defects or is not otherwise patentable, the Office invites the applicant to submit corrections and/or amendments. TPDL Art. 55.07 PUBLICATION. The application is published in Turkish soon after the Turkish translation is filed..08 REQUEST FOR SEARCH. No special request for search need be filed and no search fee is required if an international search report has been established. If no international search report has been established, a special request for search must be filed, and the corresponding search fee must be paid. The amount of the search fee is indicated in Annex.I. TPDL Art. 59 60 61 62.09 REQUEST FOR EXAMINATION. Substantive examination is carried out only upon request. If no request for examination is filed, a patent without examination will be granted, which will be valid for seven years. No request for examination need be filed if the international application is accompanied by an international preliminary examination report which is favorable with regard to novelty, inventive step and industrial applicability. Otherwise, the application is subject to substantive examination. TPDL Art. 45.10 DIVISIONAL APPLICATIONS. Where the application lacks unity of invention, the applicant will be invited to file divisional applications which will benefit from the same filing date and any applicable priority date as the international application which entered the national phase. PCT Art. 28 41 TPDL Art. 62 64.11 AMENDMENTS AND CORRECTIONS; TIME LIMITS. Amendments and corrections may be made before the grant of the patent provided that they do not go beyond the scope of the application as filed. For filing of divisional applications, see above..12 ANNUAL FEES. Annual fees shall be paid for the second and each subsequent year following the international filing date. The first fee shall be paid within 30 months from the international filing date or from the priority date, if any (or 33 months provided the applicant pays the fee for requesting extension of time for entry into the national phase). The mentioned first fee can be paid after the date of entering the national phase, provided payment is made within six months from that date, together with a 25% additional fee. Delays in meeting time limits for payment of annual fees may be excused but only if they are due to force majeure and if the applicant so requests within six months from the date on which the invalidity is published.

The applicable procedure is outlined in paragraphs 6.018 to 6.021 of the National Phase. PCT Art. 24(2) 48(2) PCT Rule 82bis TPDL Art. 134 173(2).14 EXCUSE OF DELAYS IN MEETING TIME LIMITS. Reference is made to paragraphs 6.022 to 6.027 of the National Phase. PCT Rule 49.6.15 REINSTATEMENT OF RIGHTS. Reinstatement of rights may be requested where the applicant failed to observe a time limit set by the Office in spite of due care, which is prejudicial to his rights. A request for reinstatement must be presented in writing within two months from the removal of the cause of the failure to observe the time limit or twelve months from the date of expiration of the applicable time limit, whichever time limit expires earlier. Within the said two months, the omitted action must be completed and the fee for reinstatement of rights (see Annex.I) must be paid. TPDL Art. 121.16 PATENTS OF ADDITION. In respect of patents of addition, compliance with the requirement of inventive step is not required. TPDLArt. 65.17 CONVERSION FROM PATENT TO UTILITY MODEL AND VICE VERSA. An application for a patent may be converted into an application for a utility model, and vice versa, subject to the payment of a conversion fee. For the applicable amount of the fee, see Annex.I.
