4 Foreword Önsöz ÖNSÖZ FOREWORD Toplumsal ve ekonomik konularla ilgili al nacak her karar ve yap lacak her türlü yat r mda istatistiksel bilgilerin önemi yads namaz bir gerçektir. Doğru ve çabuk karar almada gerekli bilgiyi sağlamak ve bilgi çağ n n gereği olan yenileşmeye ve gelişmeye aç k olmak, ülkemizin bugünü ve geleceği için önemlidir. Gelişme ve değişme hedeflerinin belirlenmesinde ve bu hedeflerin başar ya ulaşmas nda güncel ve ayn zamanda güvenilir verilere gereksinim giderek artmakta, ulusal ve uluslararas stratejik hedeflerin belirlenmesinde ve bu hedeflerin başar s n n ölçülmesinde doğru, güncel ve güvenilir istatistiklere ihtiyaç duyulmaktad r. The importance of the statistical information in each decision and each kind of investment related to the social and economic issues is an undeniable fact.to give the necessary information for making a correct and prompt decision and to be open for innovation and development are important for the present and future of our country. The requirement for up-to-date and also reliable information is gradually increasing in determination of the development and objectives for changing and the accomplishment of these objectives and it is needed for correct, up-to-date and reliable statistics for determining the international strategic objectives and measuring the successes of these objectives. The statistical data useful for creating information is the most important numerical keys for understanding the past better, perceiving this day more objectively and correctly.the statistics assessing qualifiedly data having no qualification has helped us to eliminate the uncertainties. Both the researchers and the decision makers are seen to use efficiently the statistical data in their studies in the authentic interpretation of the information and resolution process at the present time. In this framework, the data has been collected by determining the variables within the framework of The Official Statistics Programme by our General Directorate being conscious of collecting and assessing information; the decision makers have been leaded by forming a statistical information source by means of the reliable, conforming the international standards, objective, qualified, comparable, consistent and timely data. The judicial statistics; have the characteristics of guide within the framework of making the forward-looking predictions and determining policies concerning the progress of the system by commenting the numeric data in the legal and judicial system. The publication of Judicial Statistics published regularly by our General Directorate every year has revealed the halting points of the available order in our judicial system and played a leading role in producting the necessary solutions. The book of Judicial Statistics 2014 has raised awareness by revealing the 2014 functioning of Turkish jurisdiction and the statistical information used in internal services of our Ministry has been presented for the consideration of lawyers, scientists, all national and international users as it does every year. I wish that Judicial Statistics 2014 playing a leading role in revealing the activities of our judicial department in the last decade and raising awareness in jurisdiction will be useful for doctrine and application and congratulate those who contributed for preparing this publication. Bilimsel metotlarla elde edilmiş güvenilir istatistikler olmaks z n doğru kararlar al nmas, k sa veya uzun vadeli plânlar yap lmas düşünülemez. Küreselleşen dünyada bilgi toplumlar, çağ n gerekliliklerini yerine getirmek ad na yapt ğ araşt rmalarda istatistik biliminden faydalanmaktad r. Nitekim, belirli bir alana ilişkin sonuç ç karmak ve buna bağl olarak plân ve düzenleme yapmak için adlî, idarî, malî, kültürel, bilimsel ve toplumsal alanlarda toplanan verilerin s n fland r lmas, çözümlenmesi ve yorumlanmas nda istatistik büyük önem arz etmektedir. Having correct and well-timed information is one of the most important factors in order to determine true policies for development of a country. It is not imaginable to make correct decisions and plans in short and long term without credible statistics which is collected with scientific methods. In globalizing world, information societies use statistics in their researches in order to fulfill the necessities of time. Thus, statistics has great importance in classifying, analyzing and interpreting data collected in judicial, administrative, financial, cultural, scientific and social fields in order to make a deduction for a special field and make plans and arrangements accordingly. Adalet istatistikleri; suç niteliği taş yan eylemlerin savc l k ve mahkemeleri ilgilendiren say sal dökümleri ile diğer başvuru ve davalar n veri kay tlar ndan oluşmaktad r. Genel Müdürlüğümüz, Bakanlar Kurulu Karar uyar nca haz rlanan Resmî İstatistik Program na ait verilerin toplanmas, düzenlenmesi ve yorumlanmas nda, adalet teşkilât m zdaki güvenilir ve güncel bilgilerin analizi ile geleceğe yönelik trendi göstererek, belirsizlikleri anlamam z kolaylaşt rmak suretiyle doğru kararlar al nmas n sağlama hususundaki bu görevi en iyi şekilde yerine getirmektedir. In this context, statistics is one of the most important instruments in order to light the way of information societies, also evaluates the society in a body and enables creating judicial statistics with lighting justice field. Judicial statistics consists of data records of other cases and requests, with numeric data concerning public prosecutor's offices and courts of acts which constitute a crime. Our Directorate General ideally does it's duty in collecting, editing and interpreting data which belongs to Official Statistics Programme prepared in accordance with the decree of Council of Ministers and helping us to understand uncertainties by showing the trend for future with analysis of the current and reliable information of judicial organization. Adalet İstatistikleri 2014 yay n, adalet ve hukuk sisteminin y llar aras ndaki dönemi ve bu y llara ait verilerin ileriye yönelik işleyişinin kaliteli bir şekilde yap land r lmas na imkân sağlayan istatistikî sonuçlar içermektedir. Dolay s yla, tutulan istatistikî veriler çerçevesinde haz rlanan bu eser, geçmişi daha iyi anlaman n ve analiz etmenin, bugünü daha objektif ve doğru bir şekilde kavraman n ve geleceği en iyi şekilde öngörerek plânlaman n anahtar olarak isimlendirilebilir. Nitekim, bu anahtarlar sayesinde geleceğe yönelik bilinçli ad mlar n at lmas söz konusu olabilecektir. Hukuk sistemimizin işleyişi ile ilgili eksikliklerin ve aksakl klar n giderilip düzeltilmesi, ileriye yönelik plan ve programlar n yap lmas, yeni projelerin üretilmesi sürecinde bu alanla ilgili olarak göstergelere ihtiyaç duyulacağ yads namaz bir gerçektir. Bu göstergelerin hesaplanmas nda kullan lan verilerin önemli bir k sm n adalet istatistiklerinde bulmak mümkündür. Adalet istatistikleri yay n, adli birimlere ait verileri, yarg daki davalar n seyri ile suç ve suçluluk hareketleri ve ülke genelindeki dağ l m n, davalardaki karar türlerini, san k, müşteki, mağdur ve taraflara ilişkin bilgileri içermektedir. In order to form future within the course of needs, the past should be analysed well in our country, like in the other countries of the world. It is an undeniable fact that, to overcome deficiencies and shortcomings in the operation of our law system, to make future plans and programmes in the process of new projects, people need some indicators related to that field. It is possible to find significant part of these data used to account these indicators in judicial statistics. Judicial statistics contains data on supreme courts, course of cases, crime and criminality trends and their distribution on the country level, information on decision types, accused persons, complainants, victims and parties in cases. 2. Tarihçe 2. Background Adli istatistik verileri, Adalet Bakanl ğ Ceza İşleri Genel Müdürlüğü'ne bağl şube müdürlüğü taraf ndan derlenmekte iken, bu görev 1979 y l nda kurulan Adli Sicil ve İstatistik Genel Müdürlüğü'ne verilmiş ve ilk kez 1982 y l nda adalet istatistikleri y ll ğ kapsam nda yay mlanm şt r. In 1986, an agreement was reached on data exchange between General Directorate and State Institute of Statistics. Therefore, General Directorate compiled data from courts, Public prosecutors' offices and enforcement directorates and published yearly. The data were also given to the Institute. With the various and increasing request of information and with the influence of the current legislation, the statistical forms have been revised, new forms have been developed and the content of publication has constantly been widened. The responsibility of data compilation and publication belonging to the publication "Judicial Statistics" being published by Turkish Statistical Institute in accordance with Official Statistics Programme abbreviated as RIP and implemented after being published in the Official Gazzette dated and numbered prepared on the basis of Turkish Statistics Law No has been set upon the Ministry of Justice General Directorate of Judicial Record and Statistics. Accordingly, as of 2006, the publication "Judicial Statistics" is being prepared by General Directorate of Judicial Record and Statistics in cooperation with Turkish Statistical Institute. XVI

The data on courts, public prosecutors' offices, enforcement directorates in provinces and districts all over Turkey along with the Constitutional Court, the Supreme Court, the Council of State, Court of Jurisdictional Disputes, Military Supreme Court, Military High Administrative Court, the Ministry of National Defence, the Department of Military Justice Affairs, High Arbitration Committee, Turkish Notary Public Union, Council of Forensic Medicine are included in the publication. The data have been obtained in electronic media from National Judiciary Network Information System as of 06 April The updates conducted by judicial units following this date have been omitted from the publication. 5. Data compiling method: In the year 2008 and before, the information belonging to Public prosecutors' offices, judicial and administrative courts, Enforcement Directorates were compiled by mail through complete count method and published yearly on the web and in printed form by the General Directorate after edit-coding process on data, data recording, analysis and reporting. The information concerning courts, Public Prosecutors' Offices and Enforcement Directorates is also present within the content of National Judiciary Network Project (UYAP) being implemented by the Ministry of Justice. Therefore, as of 2009, the information in the Judicial Statistics Publication have been obtained on the basis of judicial unit records existent in National Judiciary Network database. Differences have occured in the description of certain data due to this change in data-compilation method in 2009 in comparison with previous years. Therefore, this condition needs to be taken into consideration in the comparison of the data with the previously present data. For example; while one type of case used to be counted in the file of principal in criminal and civil courts in the year 2008 and before, all types of cases have been counted in the file of principal in the year Further more, the information belonging to the number of accused persons upon whom a judicial fine along with imprisonment was imposed has been assessed altogether. The Constitutional Court: The Constitutional Court reviews the constitutionality of laws, government decrees with the power of law and the by-laws of the Turkish Grand National Assembly (Constitution, Art. 148). The Supreme Court: The Supreme Court is the court of last instance for reviewing the decisions and verdicts rendered by courts of law and in matters not referred by law to other courts of law. It has first and final jurisdiction in specific cases defined by law (Constitution, Art. 154). The Council of State: The Council of State is the court of last instance for reviewing the decisions and verdicts rendered by administrative courts and in matters not referred to other courts of administration by law. It has first and final jurisdiction in specific cases defined by law. The Council of State hears and settles administrative disputes and suits; expresses opinions on draft laws submitted by the Prime Minister and Council of Ministers; examines draft regulations, specifications and contracts of consessions; and discharges other duties as prescribed by law (Constitution, Art. 155). The Military Supreme Court: The Military Supreme Court is the court of the last instance to review decisions and verdicts rendered by military courts. Furthermore, it hears specific cases as a court of the first and last instance involving military matters as prescribed by law (Constitution, Art. 156). The Military High Administrative Court: The Military High Administrative Court is the court of the first and the last instance to review disputes appeared by administrative procedures related to the military service and military person even if it is caused by the nonmilitary authorities (Constitution, Art. 157). The Court of Jurisdictional Disputes: The Court of Jurisdictional Disputes is empowered to settle disputes among juridical, administrative, and military courts arising from disagreements on jurisdictional matters and verdicts (Constitution, Art.158). High Arbitration Committee: High Arbitration Committee is a committee chaired by the Supreme Court, Head of Department responsible for Cases of Labour and is fully authorized in signing of the collective agreement where disputes arise because strike and lockout are prohibited or postponed, and an agreement is not made for a certain period of time (Law on Collective Labour Agrement, Strike and Lockout No. 2822, Art. 52). Division of Forensic Medicine: Division of Forensic Medicine is an institution, which is affiliated to the Ministry of Justice. It has been established in order to function as an expert on judicial matters, arrange programmes on forensic medicine expertism and minor branch expertism and organize symposiums, conferences and similar activities in the field concerned and other judicial sciences and apply educational programmes related to such (Law on Division of Forensic Medicine No. 2659, Art. 1).
